                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation of an offense for advertising for the
 1-3     adoption of a child.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Sections 25.09(a) and (b), Penal Code, are amended
 1-6     to read as follows:
 1-7           (a)  A person commits an offense if the person advertises in
 1-8     the public media that the person is seeking a child for adoption,
 1-9     will place a child for adoption, or will provide or obtain a child
1-10     for adoption.
1-11           (b)  This section does not apply to a [licensed]
1-12     child-placing agency licensed in this state that is identified in
1-13     the advertisement as a licensed child-placing agency.
1-14           SECTION 2. (a)  This Act takes effect September 1, 2001.
1-15           (b)  The change in law made by this Act pertaining to a
1-16     criminal offense applies only to an offense committed on or after
1-17     the effective date of this Act.  For purposes of this Act, an
1-18     offense is committed before the effective date of this Act if any
1-19     element of the offense occurs before that date.  An offense
1-20     committed before the effective date of this Act is covered by the
1-21     law in effect when the offense was committed, and the former law is
1-22     continued in effect for that purpose.
