                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the issuance of special license plates for motorcycles
 1-3     owned by former members of the United States armed forces and their
 1-4     surviving spouses.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Section 502.252, Transportation Code, is amended
 1-7     to read as follows:
 1-8           Sec. 502.252.  CERTAIN SPECIALIZED PLATES AVAILABLE
 1-9     PERSONALIZED. A person applying for license plates under Section
1-10     502.2555, 502.258, 502.2586, 502.259, 502.260, 502.261, 502.262,
1-11     502.263, 502.264, 502.265, 502.269, 502.270, 502.271, 502.272,
1-12     502.273, 502.2731, 502.274, 502.289, 502.291, 502.294 may:
1-13                 (1)  have a license plate number assigned by the
1-14     department; or
1-15                 (2)  apply for personalized prestige license plates
1-16     under Section 502.251.
1-17           SECTION 2. Subchapter F, Chapter 502, Transportation Code, is
1-18     amended by adding Section 502.2586 to read as follows:
1-19           Sec. 502.2586.  MOTORCYCLES OF FORMER MEMBERS OF UNITED
1-20     STATES ARMED FORCES. (a)  The department shall issue specially
1-21     designed license plates for motorcycles owned by retired or
1-22     honorably discharged members of the United States armed forces.
1-23           (b)  License plates issued under this section must include
1-24     the words "U.S. Veteran."
 2-1           (c)  The department shall issue license plates under this
 2-2     section to a person who:
 2-3                 (1)  applies to the department on a form prescribed by
 2-4     the department;
 2-5                 (2)  pays the annual fee prescribed by Subsection (e),
 2-6     in addition to the fee prescribed by Section 502.160, and, if a
 2-7     personalized prestige license plate is issued, in addition to the
 2-8     fee prescribed by Section 502.251; and
 2-9                 (3)  submits proof that the person is eligible under
2-10     this section.
2-11           (d)  The department shall send 50 cents of each fee collected
2-12     under this section to the county treasurer of the county in which
2-13     the applicant resides.  The county treasurer shall credit money
2-14     received under this section to the general fund of the county to
2-15     pay the costs of administering this section.
2-16           (e)  The annual fee for issuance of license plates under this
2-17     section is:
2-18                 (1)  $5 for the first license plate; and
2-19                 (2)  $7.50 for each additional license plate.
2-20           (f)  If the owner of a motorcycle registered under this
2-21     section disposes of the motorcycle during the registration year,
2-22     the owner shall return the special license plate to the department.
2-23     The owner may then apply for issuance of that plate to another
2-24     motorcycle.
2-25           SECTION 3. Sections 502.266(g) and (h), Transportation Code,
2-26     are amended to read as follows:
2-27           (g)  The surviving spouse of a person who would be eligible
 3-1     for a motorcycle license plate under Section 502.2586 is entitled
 3-2     to register one motorcycle under that section as long as the spouse
 3-3     remains unmarried.
 3-4           (h) An applicant for registration under this section must
 3-5     submit proof of the eligibility of the applicant's deceased spouse
 3-6     for registration under Section 502.254, 502.2555, 502.257, 502.258,
 3-7     502.2586, 502.259, 502.260, or 502.264, as applicable.
 3-8           (i) [(h)]  The county assessor-collector shall require an
 3-9     applicant for registration under this section to make a statement
3-10     that the spouse is unmarried.  The statement must be sworn if the
3-11     spouse renews a registration under Section 502.257, 502.259, or
3-12     502.260.
3-13           SECTION 4. This Act takes effect September 1, 2001.
