1-1 AN ACT
1-2 relating to the authorization and regulation of progressive bingo
1-3 games.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 2001.002, Occupations Code, is amended by
1-6 adding Subdivision (29) to read as follows:
1-7 (29) "Progressive bingo" means a bingo game:
1-8 (A) in which in order to win, a specific pattern
1-9 must be completed by the time a specified number of bingo numbers
1-10 or symbols have been selected during a single bingo occasion;
1-11 (B) that may continue over successive bingo
1-12 occasions of the same licensed authorized organization until a
1-13 player wins; and
1-14 (C) for which the prize amount is increased on
1-15 each successive bingo occasion until a player wins.
1-16 SECTION 2. Subchapter I, Chapter 2001, Occupations Code, is
1-17 amended by adding Section 2001.421 to read as follows:
1-18 Sec. 2001.421. PROGRESSIVE BINGO GAMES. (a) A licensed
1-19 authorized organization may conduct a progressive bingo game.
1-20 (b) Only one progressive bingo game may be conducted during
1-21 a bingo occasion.
1-22 (c) Section 2001.420(a) does not apply to a progressive
1-23 bingo game. The prizes awarded in a progressive bingo game are not
1-24 included in the aggregated value of prizes awarded at a single
2-1 bingo occasion for purposes of Section 2001.420(b).
2-2 (d) The prize offered or awarded for a progressive bingo
2-3 game may not exceed $750 at the first bingo occasion during which
2-4 the game is played and may be increased by not more than $500 at
2-5 each successive bingo occasion at which the game is played until
2-6 the game is won.
2-7 (e) If the prize for a progressive bingo game is not awarded
2-8 at a bingo occasion, the progressive bingo game must be continued
2-9 at a future bingo occasion of the same organization until a winner
2-10 is declared.
2-11 (f) A consolation prize of not more than $250 for a
2-12 progressive bingo game may be awarded at each bingo occasion during
2-13 which the game is played.
2-14 (g) A licensed authorized organization conducting a
2-15 progressive bingo game must post the rules for the progressive
2-16 bingo game as part of the organization's house rules before the
2-17 start of the bingo occasion. Except as otherwise required by rule
2-18 of the commission, the posted rules must remain in effect until a
2-19 winner is declared for the progressive bingo game.
2-20 (h) If more than one licensed authorized organization
2-21 conducts bingo at the same location, each organization is
2-22 responsible for the organization's own progressive bingo game.
2-23 (i) A licensed authorized organization conducting a
2-24 progressive bingo game must maintain adequate records relating to
2-25 the game as required by rule of the commission. The records must:
2-26 (1) include the amount of the increase in the prize at
2-27 each bingo occasion at which the game is continued; and
3-1 (2) account for all gross receipts for each
3-2 progressive bingo game.
3-3 (j) Sections 2001.502 and 2001.503 apply to a prize awarded
3-4 in a progressive bingo game, including a consolation prize.
3-5 (k) The commission shall adopt rules to administer this
3-6 section.
3-7 SECTION 3. (a) This Act takes effect immediately if it
3-8 receives a vote of two-thirds of all the members elected to each
3-9 house, as provided by Section 39, Article III, Texas Constitution.
3-10 If this Act does not receive the vote necessary for immediate
3-11 effect, this Act takes effect September 1, 2001.
3-12 (b) The Texas Lottery Commission shall adopt rules to
3-13 administer progressive bingo games under Section 2001.421,
3-14 Occupations Code, as added by this Act, not later than October 1,
3-15 2001. A licensed authorized organization may not conduct a
3-16 progressive bingo game under Section 2001.421, Occupations Code, as
3-17 added by this Act, before the commission adopts those rules.
