 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the authorization and regulation of progressive bingo
 1-9     games.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 2001.002, Occupations Code, is amended by
1-12     adding Subdivision (29) to read as follows:
1-13                 (29)  "Progressive bingo" means a bingo game:
1-14                       (A)  in which in order to win, a specific pattern
1-15     must be completed by the time a specified number of bingo numbers
1-16     or symbols have been selected during a single bingo occasion;
1-17                       (B)  that may continue over successive bingo
1-18     occasions of the same licensed authorized organization until a
1-19     player wins; and
1-20                       (C)  for which the prize amount is increased on
1-21     each successive bingo occasion until a player wins.
1-22           SECTION 2. Subchapter I, Chapter 2001, Occupations Code, is
1-23     amended by adding Section 2001.421 to read as follows:
1-24           Sec. 2001.421.  PROGRESSIVE BINGO GAMES. (a)  A licensed
1-25     authorized organization may conduct a progressive bingo game.
1-26           (b)  Only one progressive bingo game may be conducted during
1-27     a bingo occasion.
1-28           (c)  Section 2001.420(a) does not apply to a progressive
1-29     bingo game.  The prizes awarded in a progressive bingo game are not
1-30     included in the aggregated value of prizes awarded at a single
1-31     bingo occasion for purposes of Section 2001.420(b).
1-32           (d)  The prize offered or awarded for a progressive bingo
1-33     game may not exceed $750 at the first bingo occasion during which
1-34     the game is played and may be increased by not more than $500 at
1-35     each successive bingo occasion at which the game is played until
1-36     the game is won.
1-37           (e)  If the prize for a progressive bingo game is not awarded
1-38     at a bingo occasion, the progressive bingo game must be continued
1-39     at a future bingo occasion of the same organization until a winner
1-40     is declared.
1-41           (f)  A consolation prize of not more than $250 for a
1-42     progressive bingo game may be awarded at each bingo occasion during
1-43     which the game is played.
1-44           (g)  A licensed authorized organization conducting a
1-45     progressive bingo game must post the rules for the progressive
1-46     bingo game as part of the organization's house rules before the
1-47     start of the bingo occasion.  Except as otherwise required by rule
1-48     of the commission, the posted rules must remain in effect until a
1-49     winner is declared for the progressive bingo game.
1-50           (h)  If more than one licensed authorized organization
1-51     conducts bingo at the same location, each organization is
1-52     responsible for the organization's own progressive bingo game.
1-53           (i)  A licensed authorized organization conducting a
1-54     progressive bingo game must maintain adequate records relating to
1-55     the game as required by rule of the commission.  The records must:
1-56                 (1)  include the amount of the increase in the prize at
1-57     each bingo occasion at which the game is continued; and
1-58                 (2)  account for all gross receipts for each
1-59     progressive bingo game.
1-60           (j)  Sections 2001.502 and 2001.503 apply to a prize awarded
1-61     in a progressive bingo game, including a consolation prize.
1-62           (k)  The commission shall adopt rules to administer this
1-63     section.
1-64           SECTION 3.  (a)  This Act takes effect immediately if it
 2-1     receives a vote of two-thirds of all the members elected to each
 2-2     house, as provided by Section 39, Article III, Texas Constitution.
 2-3     If this Act does not receive the vote necessary for immediate
 2-4     effect, this Act takes effect September 1, 2001.
 2-5           (b)  The Texas Lottery Commission shall adopt rules to
 2-6     administer progressive bingo games under Section 2001.421,
 2-7     Occupations Code, as added by this Act, not later than October 1,
 2-8     2001.  A licensed authorized organization may not conduct a
 2-9     progressive bingo game under Section 2001.421, Occupations Code, as
2-10     added by this Act, before the commission adopts those rules.
