                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the procedure for notifying certain fire fighters or
 1-3     police officers of disciplinary suspensions.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 143.117(c), Local Government Code, is
 1-6     amended to read as follows:
 1-7           (c)  If the department head suspends a fire fighter or police
 1-8     officer, the department head shall notify the fire fighter or
 1-9     police officer within 120 hours after the decision is made to
1-10     suspend the fire fighter or police officer.  Notice may be
1-11     delivered in person or by certified mail to the last known address
1-12     in the fire fighter's or police officer's personnel file or to a
1-13     designated fire fighter or police officer association
1-14     representative.  The department head shall, promptly after
1-15     providing notice,[, within 120 hours after the fire fighter or
1-16     police officer is notified of the suspension,] file a written
1-17     statement of action with the commission.
1-18           SECTION 2.  This Act takes effect September 1, 2001.
