                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to health benefit plan coverage for certain students
 1-3     enrolled at certain medical and dental units.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter Z, Chapter 51, Education Code, is
 1-6     amended by adding Section 51.961 to read as follows:
 1-7           Sec. 51.961.  STUDENT HEALTH BENEFIT PLAN COVERAGE. (a)  In
 1-8     this section, "governing board" and "medical and dental unit" have
 1-9     the meanings assigned by Section 61.003.
1-10           (b)  The governing board of a medical and dental unit may
1-11     require a student enrolled at the medical and dental unit to have
1-12     in effect during each academic period of enrollment health benefit
1-13     plan coverage for health care services received by the student.
1-14           (c)  The governing board shall determine the minimum coverage
1-15     required under this section and may adopt any rules considered
1-16     necessary by the board to accomplish the purposes of this section.
1-17           (d)  A governing board that requires student health benefit
1-18     plan coverage under Subsection (b) may provisionally admit a
1-19     student who does not have the required minimum coverage to give the
1-20     student an opportunity to obtain the required coverage.  The
1-21     governing board may not provisionally admit a student under this
1-22     subsection for more than one semester or summer session.
1-23           SECTION 2.  This Act takes effect immediately if it receives
1-24     a vote of two-thirds of all the members elected to each house, as
 2-1     provided by Section 39, Article III, Texas Constitution.  If this
 2-2     Act does not receive the vote necessary for immediate effect, this
 2-3     Act takes effect September 1, 2001.
