 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to tuition charges by school districts for certain
 1-9     military dependents.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 25.004, Education Code, is amended to read
1-12     as follows:
1-13           Sec. 25.004.  TUITION FOR CERTAIN MILITARY DEPENDENTS
1-14     PROHIBITED. A school district may not charge tuition for the
1-15     attendance of a student who is [not] domiciled in another [this]
1-16     state and resides in military housing that is located in the
1-17     district but is exempt from taxation by the district. [The tuition
1-18     rate may not exceed an amount equal to the district's average
1-19     expenditure per student from local funds.]
1-20           SECTION 2. This Act applies beginning with the 2001-2002
1-21     school year.
1-22           SECTION 3.  This Act takes effect immediately if it receives
1-23     a vote of two-thirds of all the members elected to each house, as
1-24     provided by Section 39, Article III, Texas Constitution.  If this
1-25     Act does not receive the vote necessary for immediate effect, this
1-26     Act takes effect September 1, 2001.
