No. 2145 77R7822 QS-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to a fee imposed on persons convicted of an offense to 1-3 support the Correctional Management Institute of Texas and the 1-4 Criminal Justice Center at Sam Houston State University and to fund 1-5 scholarships for state correctional officers. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. Article 102.075, Code of Criminal Procedure, is 1-8 amended by adding Subsection (n) to read as follows: 1-9 (n) In addition to the costs on conviction imposed by 1-10 Subsections (a) and (m), a person convicted of an offense described 1-11 by Subsection (a) shall pay $1 on conviction of the offense. The 1-12 comptroller shall deposit money received under this subsection to 1-13 the credit of the Correctional Management Institute of Texas and 1-14 Criminal Justice Center account. Subsection (h) does not apply to 1-15 money received under this subsection. 1-16 SECTION 2. Subchapter D, Chapter 96, Education Code, is 1-17 amended by adding Sections 96.65 and 96.651 to read as follows: 1-18 Sec. 96.65. CORRECTIONAL MANAGEMENT INSTITUTE OF TEXAS AND 1-19 CRIMINAL JUSTICE CENTER ACCOUNT. The Correctional Management 1-20 Institute of Texas and Criminal Justice Center account is in the 1-21 state treasury. Money in the account may be appropriated only for 1-22 a purpose provided by this section. The president of Sam Houston 1-23 State University shall use the account for administering the 1-24 institute and the center at the university and for funding 2-1 scholarships awarded by the Correctional Management Institute of 2-2 Texas as provided by Section 96.651. 2-3 Sec. 96.651. SCHOLARSHIPS FOR STATE CORRECTIONAL OFFICERS. 2-4 (a) In this section, "institution of higher education" has the 2-5 meaning assigned by Section 61.003. 2-6 (b) Each year the president of Sam Houston State University 2-7 shall reserve 3.5 percent of the amount credited on January 1 to 2-8 the Correctional Management Institute of Texas and Criminal Justice 2-9 Center account for scholarships for state correctional officers. 2-10 (c) Any state correctional officer who has been employed as 2-11 a state correctional officer for at least two years may apply for a 2-12 scholarship under this section to be used in pursuit of any 2-13 certificate, associate degree, or baccalaureate degree at an 2-14 institution of higher education. 2-15 (d) The director of the Correctional Management Institute of 2-16 Texas shall administer the scholarship awards, including the 2-17 selection of recipients and the determination of the amounts and 2-18 conditions of the scholarships. 2-19 (e) The director shall adopt a written policy relating to 2-20 the establishment of the scholarships, including eligibility 2-21 criteria and the amounts and conditions of the scholarships. 2-22 (f) The policy must be made available to the public in 2-23 advance of any deadline established by the director for the 2-24 submission of an application under this section. 2-25 SECTION 3. This Act takes effect September 1, 2001.
