                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the designation of excess funds in the compensation to
 1-3     victims of crime fund.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Articles 56.541(b) and (c), Code of Criminal
 1-6     Procedure, are amended to read as follows:
 1-7           (b)  At the time the attorney general certifies the estimates
 1-8     made under Subsection (a), the attorney general shall also certify
 1-9     for the next state fiscal biennium the amount of excess money in
1-10     the compensation to victims of crime fund for purposes of
1-11     Subsection (c), calculated by multiplying the amount estimated
1-12     under Subsection (a)(2) by 120 percent, and subtracting that
1-13     product from the sum of the amounts estimated under Subsections
1-14     (a)(1) and (a)(3).  The attorney general shall designate the excess
1-15     money as the Nell Myers estimated account for victim-related
1-16     services and assistance.
1-17           (c)  For a state fiscal biennium, the legislature may
1-18     appropriate from the compensation to victims of crime fund the
1-19     amount of [excess] money in the Nell Myers estimated account for
1-20     victim-related services and assistance [fund certified for the
1-21     biennium under Subsection (b)] to state agencies that deliver or
1-22     fund victim-related services or assistance.
1-23           SECTION 2. This Act takes effect September 1, 2001.
