A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to special license plates in honor of the YMCA in Texas.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 502.299, Transportation Code, as added by
1-5 Chapter 433, Acts of the 76th Legislature, Regular Session, 1999,
1-6 is amended by amending Subsections (b) and (c) and by adding
1-7 Subsection (d) to read as follows:
1-8 (b) The department shall issue license plates under this
1-9 section to a person who:
1-10 (1) applies to the county assessor-collector of the
1-11 county in which the person resides on a form provided by the
1-12 department; and
1-13 (2) pays an [the] annual fee of $30 [established by
1-14 the department under Subsection (c)], in addition to the fee
1-15 prescribed by Section 502.161 or 502.162 [,] and, if personalized
1-16 prestige license plates are issued, in addition to the fee
1-17 prescribed by Section 502.251.
1-18 (c) Of each fee collected under Subsection (b)(2), $8 shall
1-19 be used by the department only to defray the cost of administering
1-20 this section. The department shall deposit the remainder of each
1-21 fee collected to the credit of the Young Men's Christian
1-22 Association (YMCA) account established by Section 7.025, Education
1-23 Code [The department by rule shall establish the annual fee for
1-24 registration under this section in an amount that, when added to
2-1 the other fees collected by the department, does not exceed the
2-2 amount sufficient to recover the actual cost to the department of
2-3 issuing license plates under this section].
2-4 (d) If the owner of a vehicle for which license plates were
2-5 issued under this section disposes of the vehicle during a
2-6 registration year, the owner shall return the special license
2-7 plates to the department.
2-8 SECTION 2. Subchapter B, Chapter 7, Education Code, is
2-9 amended by adding Section 7.025 to read as follows:
2-10 Sec. 7.025. YOUNG MEN'S CHRISTIAN ASSOCIATION (YMCA)
2-11 ACCOUNT. (a) The Young Men's Christian Association (YMCA) account
2-12 is a separate account in the general revenue fund. The account is
2-13 composed of money deposited to the credit of the account under
2-14 Section 502.299, Transportation Code, as added by Chapter 433, Acts
2-15 of the 76th Legislature, Regular Session, 1999. Money in the
2-16 account may be used only for the purposes of this section.
2-17 (b) The Texas Education Agency administers the account. The
2-18 agency may spend money credited to the account only to make grants
2-19 to benefit the youth and government programs sponsored by the Young
2-20 Men's Christian Associations located in Texas.
2-21 SECTION 3. This Act takes effect September 1, 2001, and
2-22 applies only to a registration fee for a registration period
2-23 beginning on or after that date.
