A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the hours of work of county employees.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 157.021, Local Government Code, is amended
1-5 to read as follows:
1-6 Sec. 157.021. HOURS OF WORK OF COUNTY EMPLOYEES. (a) The
1-7 [In a county with a population of 355,000 or more, the]
1-8 commissioners court of a county may adopt and enforce uniform rules
1-9 on the hours of work of department heads, assistants, deputies, and
1-10 other employees whose compensation is set or approved by the court.
1-11 (b) The commissioners court of a [any] county may adopt and
1-12 enforce uniform rules on overtime and compensatory time for
1-13 department heads, assistants, deputies, and other employees whose
1-14 compensation is set or approved by the commissioners court. The
1-15 rules may:
1-16 (1) prohibit unbudgeted overtime, except when the
1-17 commissioners court or an elected county or district officer
1-18 declares an emergency; and
1-19 (2) require that emergency overtime be reported to the
1-20 county auditor and the commissioners court.
1-21 SECTION 2. This Act takes effect immediately if it receives
1-22 a vote of two-thirds of all the members elected to each house, as
1-23 provided by Section 39, Article III, Texas Constitution. If this
1-24 Act does not receive the vote necessary for immediate effect, this
2-1 Act takes effect September 1, 2001.
