1-1                                   AN ACT
 1-2     relating to the authorized use of an unmarked vehicle by a
 1-3     municipal employee to conduct an investigation involving suspected
 1-4     fraud or other mismanagement.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 721.005(a), Transportation Code, is
 1-7     amended to read as follows:
 1-8           (a)  The governing body of a municipality may exempt from the
 1-9     requirements of Section 721.004:
1-10                 (1)  an automobile when used to perform an official
1-11     duty by a:
1-12                       (A) [(1)]  police department;
1-13                       (B) [(2)]  magistrate as defined by Article 2.09,
1-14     Code of Criminal Procedure; or
1-15                       (C) [(3)]  medical examiner; or
1-16                 (2)  an automobile used by a municipal employee only
1-17     when conducting an investigation involving suspected fraud or other
1-18     mismanagement within the municipality.
1-19           SECTION 2.  This Act takes effect immediately if it receives
1-20     a vote of two-thirds of all the members elected to each house, as
1-21     provided by Section 39, Article III, Texas Constitution.  If this
1-22     Act does not receive the vote necessary for immediate effect, this
1-23     Act takes effect September 1, 2001.
