A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the issuance of a supplementary birth certificate for
1-3 certain adopted persons.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 192.006(a), Health and Safety Code, is
1-6 amended to read as follows:
1-7 (a) A supplementary birth certificate may be filed if the
1-8 person who is the subject of the certificate:
1-9 (1) becomes the child of the person's father by the
1-10 subsequent marriage of the person's parents;
1-11 (2) has the person's parentage determined by a court
1-12 of competent jurisdiction; [or]
1-13 (3) is adopted under the laws of any state; or
1-14 (4) is eligible for a supplementary birth certificate
1-15 under Section 192.008(f).
1-16 SECTION 2. Section 192.008, Health and Safety Code, is
1-17 amended by adding Subsection (f) to read as follows:
1-18 (f) Notwithstanding Subsection (a), an adopted person at
1-19 least 18 years of age is entitled to a supplementary birth
1-20 certificate under this subsection if the person's adoptive parents
1-21 and birth parents have died. A supplementary birth certificate
1-22 issued under this subsection must be in the names of the person's
1-23 birth parents contained on the person's original birth certificate.
1-24 An adopted person who applies for a supplementary birth certificate
2-1 under this subsection shall provide the state registrar with the
2-2 information necessary to issue the birth certificate.
2-3 SECTION 3. (a) The change in law made by this Act applies to
2-4 an adopted person without regard to the date on which the person
2-5 was adopted.
2-6 (b) The Texas Board of Health shall adopt rules and
2-7 prescribe forms necessary to administer this Act not later than
2-8 January 1, 2002.
2-9 SECTION 4. This Act takes effect immediately if it receives
2-10 a vote of two-thirds of all the members elected to each house, as
2-11 provided by Section 39, Article III, Texas Constitution. If this
2-12 Act does not receive the vote necessary for immediate effect, this
2-13 Act takes effect September 1, 2001.
