No. 2262 77R7047 JMM-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to certain requirements for membership on the governing 1-3 board of a state agency. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Title 2, Occupations Code, is amended by adding 1-6 Chapter 57 to read as follows: 1-7 CHAPTER 57. REQUIREMENTS FOR LICENSING AGENCIES 1-8 Sec. 57.001. DEFINITIONS. In this chapter: 1-9 (1) "License" means a license, certificate, 1-10 registration, permit, or other form of authorization required by 1-11 law or a state agency rule that must be obtained by an individual 1-12 to engage in a particular business, occupation, or profession. 1-13 (2) "State agency" means a department, board, bureau, 1-14 commission, committee, division, office, council, or agency of the 1-15 state. 1-16 Sec. 57.002. REQUIREMENTS FOR GOVERNING BOARD MEMBERSHIP. A 1-17 person may not be required to be a member of a private trade 1-18 association as a precondition to serving as a member of the 1-19 governing board of a state agency that issues a license or 1-20 otherwise regulates a business, occupation, or profession. 1-21 SECTION 2. (a) The change in law made by this Act applies to 1-22 the appointment of a person as a member of a governing board 1-23 subject to Chapter 57, Occupations Code, as added by this Act, on 1-24 or after the effective date of this Act. 2-1 (b) A member of a governing board subject to Chapter 57, 2-2 Occupations Code, as added by this Act, who is serving on the 2-3 governing board on the effective date of this Act is subject to the 2-4 law in effect on the date preceding the effective date of this Act, 2-5 and, unless otherwise removed as provided by law, may continue to 2-6 serve for the remainder of the member's term. 2-7 SECTION 3. This Act takes effect immediately if it receives 2-8 a vote of two-thirds of all the members elected to each house, as 2-9 provided by Section 39, Article III, Texas Constitution. If this 2-10 Act does not receive the vote necessary for immediate effect, this 2-11 Act takes effect September 1, 2001.
