                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a guide for historical markers along roadways in this
 1-3     state.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 442, Government Code, is amended by
 1-6     adding Section 442.0065 to read as follows:
 1-7           Sec. 442.0065.  GUIDE TO HISTORICAL MARKERS. (a)  In this
 1-8     section, "department" means the Texas Department of Transportation.
 1-9           (b)  The department, in consultation with the commission,
1-10     shall publish a guide to historical markers along roadways in this
1-11     state that includes:
1-12                 (1)  a listing of the historical markers along roadways
1-13     with identifying numbers assigned to each marker by the department;
1-14     and
1-15                 (2)  a summary of the information on each marker.
1-16           (c)  For each historical marker, the department shall erect
1-17     and maintain, when practicable, signs informing users of the
1-18     roadway of the marker and indicating the identifying number of the
1-19     marker.  A sign shall be located at or near the milepost along the
1-20     roadway immediately preceding the historical marker in each
1-21     direction.
1-22           (d)  The department shall use information from the
1-23     commission's Texas historical roadside marker restoration program
1-24     and the state historical marker program under Section 442.006 in
 2-1     creating the guide to historical markers under Subsection (b).
 2-2           (e)  The department shall make available to the public the
 2-3     guide published under Subsection (b) at a reasonable price
 2-4     determined by the department.
 2-5           SECTION 2.  This Act takes effect immediately if it receives
 2-6     a vote of two-thirds of all the members elected to each  house, as
 2-7     provided by Section 39, Article III, Texas Constitution.  If this
 2-8     Act does not receive the vote necessary for immediate effect, this
 2-9     Act takes effect September 1, 2001.
