No. 2263 1-2 (In the Senate - Received from the House May 7, 2001; 1-3 May 7, 2001, read first time and referred to Committee on State 1-4 Affairs; May 11, 2001, reported favorably by the following vote: 1-5 Yeas 8, Nays 0; May 11, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to a guide for historical markers along roadways in this 1-9 state. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Chapter 442, Government Code, is amended by 1-12 adding Section 442.0065 to read as follows: 1-13 Sec. 442.0065. GUIDE TO HISTORICAL MARKERS. (a) In this 1-14 section, "department" means the Texas Department of Transportation. 1-15 (b) The department, in consultation with the commission, 1-16 shall publish a guide to historical markers along roadways in this 1-17 state that includes: 1-18 (1) a listing of the historical markers along roadways 1-19 with identifying numbers assigned to each marker by the department; 1-20 and 1-21 (2) a summary of the information on each marker. 1-22 (c) For each historical marker, the department shall erect 1-23 and maintain, if practicable, signs informing users of the roadway 1-24 of the marker and indicating the identifying number of the marker. 1-25 The department shall erect a sign under this subsection 1-26 approximately one mile preceding the historical marker if that 1-27 placement is practicable. 1-28 (d) The department shall use information from the 1-29 commission's Texas historical roadside marker restoration program 1-30 and the state historical marker program under Section 442.006 in 1-31 creating the guide to historical markers under Subsection (b). 1-32 (e) The department shall make available to the public the 1-33 guide published under Subsection (b) at a reasonable price 1-34 determined by the department. 1-35 SECTION 2. The Texas Department of Transportation is not 1-36 required by Section 442.0065, Government Code, as added by this 1-37 Act, to replace or change a historical marker sign that was erected 1-38 before the effective date of this Act except in the normal course 1-39 of maintenance of the sign. 1-40 SECTION 3. This Act takes effect immediately if it receives 1-41 a vote of two-thirds of all the members elected to each house, as 1-42 provided by Section 39, Article III, Texas Constitution. If this 1-43 Act does not receive the vote necessary for immediate effect, this 1-44 Act takes effect September 1, 2001. 1-45 * * * * *
