No. 2268 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to minimum personal leave for faculty members at public 1-3 institutions of higher education. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter Z, Chapter 51, Education Code, is 1-6 amended by adding Section 51.961 to read as follows: 1-7 Sec. 51.961. MINIMUM PERSONAL LEAVE FOR HIGHER EDUCATION 1-8 FACULTY. (a) In this section: 1-9 (1) "Faculty member" has the meaning assigned by 1-10 Section 51.101. 1-11 (2) "Institution of higher education" has the meaning 1-12 assigned by Section 61.003. 1-13 (b) The governing board of each institution of higher 1-14 education shall adopt a policy permitting faculty members to use 1-15 five sick leave days as personal leave days in each academic year. 1-16 In the policy, the governing board may permit faculty members to 1-17 use more than five sick leave days as personal leave days in each 1-18 academic year. A faculty member may not use sick leave as personal 1-19 leave until the faculty member has accumulated a number of sick 1-20 leave days equal to or greater than the number of personal leave 1-21 days requested. 1-22 (c) A policy adopted by the governing board of an 1-23 institution of higher education under this section may regulate a 1-24 faculty member's use of sick leave as personal leave if the policy 2-1 does not restrict the purposes for which the personal leave may be 2-2 used. 2-3 (d) The governing board shall develop an appropriate form 2-4 for the use of sick leave days as personal leave days. 2-5 SECTION 2. This Act applies beginning with the 2001-2002 2-6 academic year. 2-7 SECTION 3. This Act takes effect immediately if it receives 2-8 a vote of two-thirds of all the members elected to each house, as 2-9 provided by Section 39, Article III, Texas Constitution. If this 2-10 Act does not receive the vote necessary for immediate effect, this 2-11 Act takes effect September 1, 2001.
