                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a minimum personal leave program for faculty members at
 1-3     public institutions of higher education.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter Z, Chapter 51, Education Code, is
 1-6     amended by adding Section 51.961 to read as follows:
 1-7           Sec. 51.961.  MINIMUM PERSONAL LEAVE PROGRAM FOR HIGHER
 1-8     EDUCATION FACULTY. (a)  In this section:
 1-9                 (1)  "Faculty member" has the meaning assigned by
1-10     Section 51.101.
1-11                 (2)  "Institution of higher education" has the meaning
1-12     assigned by Section 61.003.
1-13           (b)  Each institution of higher education shall adopt a
1-14     minimum personal leave program consisting of five days of personal
1-15     leave each academic year for faculty members.  An institution of
1-16     higher education may provide additional personal leave to faculty
1-17     members under this section.
1-18           (c)  The governing board of an institution of higher
1-19     education may adopt a policy regulating a faculty member's use of
1-20     personal leave granted under this section, provided that the policy
1-21     does not restrict the purposes for which the leave may be used.
1-22           (d)  A faculty member may not carry forward from one academic
1-23     year to the next any unused accumulated personal leave granted
1-24     under this section.
 2-1           SECTION 2. This Act applies beginning with the 2001-2002
 2-2     academic year.
 2-3           SECTION 3.  This Act takes effect immediately if it receives
 2-4     a vote of two-thirds of all the members elected to each house, as
 2-5     provided by Section 39, Article III, Texas Constitution.  If this
 2-6     Act does not receive the vote necessary for immediate effect, this
 2-7     Act takes effect September 1, 2001.
