                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the jurisdiction of municipal courts of record over
 1-3     health and safety and nuisance abatement ordinances.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 30.00005, Government Code, is amended by
 1-6     adding Subsection (d) to read as follows:
 1-7           (d)  The governing body of a municipality by ordinance may
 1-8     provide that the court has:
 1-9                 (1)  civil jurisdiction for the purpose of enforcing
1-10     municipal ordinances enacted under Subchapter A, Chapter 214, Local
1-11     Government Code, or Subchapter E, Chapter 683, Transportation Code;
1-12                 (2)  concurrent jurisdiction with a district court or a
1-13     county court at law under Subchapter B, Chapter 54, Local
1-14     Government Code, within the municipality's territorial limits and
1-15     property owned by the municipality located in the municipality's
1-16     extraterritorial jurisdiction for the purpose of enforcing health
1-17     and safety and nuisance abatement ordinances; and
1-18                 (3)  authority to issue:
1-19                       (A)  search warrants for the purpose of
1-20     investigating a health and safety or nuisance abatement ordinance
1-21     violation; and
1-22                       (B)  seizure warrants for the purpose of
1-23     securing, removing, or demolishing the offending property and
1-24     removing the debris from the premises.
 2-1           SECTION 2. This Act takes effect September 1, 2001.
