                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the retirement eligibility and benefits of certain
 1-3     custodial officers in the Employees Retirement System of Texas.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 814.107, Government Code, is amended by
 1-6     amending Subsection (a) and adding Subsections (h) and (i) to read
 1-7     as follows:
 1-8           (a)  Except as provided by Subsection (h), a [A] member who
 1-9     has at least 20 years of service credit as a law enforcement or
1-10     custodial officer is eligible to retire regardless of age and
1-11     receive a standard service retirement annuity in an amount and to
1-12     be funded as provided by this section.
1-13           (h)  A member  is eligible to retire and receive a standard
1-14     service retirement annuity in an amount and to be funded as
1-15     provided by this section for all service credit as a custodial
1-16     officer if the member:
1-17                 (1)  has at least 12 years of service credit as a
1-18     custodial officer on March 1, 2001;
1-19                 (2)  is transferred by the Texas Department of Criminal
1-20     Justice from a position as a custodial officer to another position
1-21     in the department; and
1-22                 (3)  has at least 20 years of total service credit.
1-23           (i)  An annuity for a retirement under Subsection (h) is
1-24     computed by adding the two products resulting from multiplying the
 2-1     member's 36 highest months of compensation for any service credit
 2-2     by:
 2-3                 (1)  2.75 for each year of custodial service; and
 2-4                 (2)  2.25 for each year of other membership service.
 2-5           SECTION 2.  This Act takes effect September 1, 2001.
