1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the creation of the County Court at Law No. 2 of Denton
1-9 County and to the jurisdiction of and certain procedure in that
1-10 court.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Section 25.0631(a), Government Code, is amended to
1-13 read as follows:
1-14 (a) Denton County has the following statutory county courts:
1-15 (1) County Court at Law No. 1 of Denton County;
1-16 (2) County Court at Law No. 2 of Denton County;
1-17 (3) County Criminal Court No. 1 of Denton County;
1-18 (4) [(3)] County Criminal Court No. 2 of Denton
1-19 County;
1-20 (5) [(4)] County Criminal Court No. 3 of Denton
1-21 County;
1-22 (6) [(5)] County Criminal Court No. 4 of Denton
1-23 County; and
1-24 (7) [(6)] County Criminal Court No. 5 of Denton
1-25 County.
1-26 SECTION 2. Section 25.0633, Government Code, is amended by
1-27 adding Subsections (e), (f), (g), and (h) to read as follows:
1-28 (e) The County Court at Law No. 2 of Denton County has
1-29 jurisdiction over all civil causes and proceedings, original and
1-30 appellate, prescribed by law for county courts.
1-31 (f) The County Court at Law No. 2 of Denton County does not
1-32 have jurisdiction over:
1-33 (1) causes and proceedings concerning roads, bridges,
1-34 and public highways;
1-35 (2) the general administration of county business that
1-36 is within the jurisdiction of the commissioners court of each
1-37 county; or
1-38 (3) criminal causes and proceedings.
1-39 (g) The County Court at Law No. 2 of Denton County has the
1-40 jurisdiction provided by general law for county courts, statutory
1-41 county courts, or district courts over civil penalties and
1-42 forfeitures, including bail bond forfeitures and escheats,
1-43 regardless of the amount in controversy or remedy sought.
1-44 (h) Appeals in all cases from judgments and orders of the
1-45 County Court at Law No. 2 of Denton County are to the court of
1-46 appeals as provided for an appeal from a district or county court.
1-47 SECTION 3. The County Court at Law No. 2 of Denton County is
1-48 created and this Act takes effect May 1, 2002.
