1-1 AN ACT
1-2 relating to the sale of certain state property from the General
1-3 Services Commission to Bethel African Methodist Episcopal Church.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. (a) The General Services Commission may convey,
1-6 on behalf of the state, the state's interest in the real property
1-7 described in Subsection (e) of this section to Bethel African
1-8 Methodist Episcopal Church, in San Antonio, Bexar County, Texas.
1-9 (b) The purchase and sale agreement relating to the
1-10 conveyance authorized by this section:
1-11 (1) shall require the Bethel African Methodist Church
1-12 to pay cash consideration in an amount that is equal to at least
1-13 the fair market value of the real property as determined by an
1-14 independent appraisal performed on behalf of the Bethel African
1-15 Methodist Episcopal Church. The appraiser selected to conduct the
1-16 appraisal is subject to the approval of the General Services
1-17 Commission and the appraisal results are subject to a review
1-18 appraisal by an appraiser selected by the General Services
1-19 Commission; and
1-20 (2) may require other terms and conditions negotiated
1-21 by the General Services Commission and the Bethel African Methodist
1-22 Episcopal Church.
1-23 (c) The General Services Commission may transfer the
1-24 property only by a special warranty deed.
2-1 (d) Sections 31.158, 31.159, and 31.161 through 31.167,
2-2 Natural Resources Code, do not apply to the conveyance authorized
2-3 by this section.
2-4 (e) The real property to which Subsection (a) of this
2-5 section refers is described as follows: Lot 1 and the West 25 feet
2-6 of Lot 2, Block 9, New City Block 582, in the City of San Antonio,
2-7 Bexar County, Texas.
2-8 SECTION 2. This Act takes effect September 1, 2001.
