                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the regulation of the location of, and aggregate piles
 1-3     maintained by the operators of, portable rock crushing machines.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter C, Chapter 382, Health and Safety Code,
 1-6     is amended by adding Section 382.0592 to read as follows:
 1-7           Sec. 382.0592.  LIMITATIONS RELATED TO OPERATIONS OF MOBILE
 1-8     ROCK CRUSHERS. (a)  This section applies only to the location and
 1-9     operation of a rock crusher that may be moved and operated in
1-10     different locations.
1-11           (b)  A rock crusher may not be operated less than one mile
1-12     from any recreational area or from a residence or other structure
1-13     that is occupied or used by a person other than the operator of the
1-14     rock crusher or the owner of the property on which the rock crusher
1-15     is operated.
1-16           (c)  Aggregate, rock, or gravel piles maintained in the
1-17     vicinity of a rock crusher may not exceed a height of 15 feet.
1-18           (d)  The commission shall adopt rules to implement this
1-19     section.
1-20           SECTION 2. This Act takes effect September 1, 2001.
