                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to techniques for management of low-level radioactive
 1-3     waste.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 402.225, Health and Safety Code, is
 1-6     amended to read as follows:
 1-7           Sec. 402.225.  BELOWGROUND DISPOSAL PROHIBITED [RESTRICTED].
 1-8     Low-level radioactive waste may not be disposed of in a landfill
 1-9     below the natural level of a disposal site [unless:]
1-10                 [(1)  federal or state regulatory programs for
1-11     low-level radioactive waste preclude or recommend against
1-12     aboveground disposal, or the authority has by rule determined that
1-13     belowground disposal provides greater protection than aboveground
1-14     disposal for public health and the environment for the period for
1-15     which the low-level waste will continue to pose a hazard to public
1-16     health and the environment;]
1-17                 [(2)  the low-level radioactive waste is contained
1-18     within a reinforced concrete barrier or within containment
1-19     structures made of materials technologically equivalent or superior
1-20     to reinforced concrete; and]
1-21                 [(3)  the low-level radioactive waste is contained in
1-22     such a manner that it can be monitored and retrieved].
1-23           SECTION 2. Section 402.154, Health and Safety Code, is
1-24     repealed.
 2-1           SECTION 3. This Act takes effect September 1, 2001, and
 2-2     applies to applications for licenses received by the commission
 2-3     before, on, or after that date.
