A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the members of the Texas Low-Level Radioactive Waste
1-3 Compact Commission.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Sections 403.001 and 403.002, Health and Safety
1-6 Code, are amended to read as follows:
1-7 Sec. 403.001. MEMBERS OF COMMISSION. (a) In this section,
1-8 "host county" has the meaning assigned by Section 2.01, Article II,
1-9 Texas Low-Level Radioactive Waste Disposal Compact (Section
1-10 403.006, Health and Safety Code).
1-11 (b) The governor shall appoint six host state commissioners
1-12 [members] to represent this state on the commission established by
1-13 Article III of the Texas Low-Level Radioactive Waste Disposal
1-14 Compact. The governor may not appoint a host state commissioner
1-15 unless the person has signed and presented to the governor a
1-16 written pledge not to propose an agreement described by Section
1-17 3.05(6) of the compact and to vote against such an agreement, if
1-18 proposed. One of the voting members of the compact commission
1-19 shall be a legal resident of the host county [Hudspeth County,
1-20 Texas].
1-21 (c) [(b)] The governor may provide an alternate for each
1-22 host state commissioner appointed under this section. An alternate
1-23 must sign and present the pledge required by Subsection (b).
1-24 (d) The governor shall remove from office a host state
2-1 commissioner or alternate who breaks the pledge presented under
2-2 Subsection (b) and shall fill the vacancy as soon as is
2-3 practicable.
2-4 Sec. 403.002. TERMS OF COMMISSION MEMBERS; VACANCY. (a) A
2-5 host state commissioner serves for a term of six years and until a
2-6 successor is appointed and qualified. A host state commissioner or
2-7 alternate is subject to removal as provided by Section 403.001(d).
2-8 (b) A vacancy in the office of host state commissioner is
2-9 filled for the unexpired term by appointment of the governor.
2-10 SECTION 2. This Act takes effect immediately if it receives
2-11 a vote of two-thirds of all the members elected to each house, as
2-12 provided by Section 39, Article III, Texas Constitution. If this
2-13 Act does not receive the vote necessary for immediate effect, this
2-14 Act takes effect September 1, 2001.
