                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the composition of the governing board of the Texas
 1-3     Department of Housing and Community Affairs.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 2306.026, Government Code, is amended by
 1-6     adding Subsections (c), (d), and (e) to read as follows:
 1-7           (c)  At least one member of the board must be a person with a
 1-8     disability.
 1-9           (d)  At least one member of the board must be an
1-10     income-eligible resident of housing that is assisted under Section
1-11     8, United States Housing Act of 1937 (42 U.S.C. Section 1437f).
1-12           (e)  A member of the board may satisfy more than one aspect
1-13     of the diversity requirements of Subsection (b), provided that the
1-14     board as a whole continues to reflect the diversity of the state.
1-15           SECTION 2.  The change in law made by this Act in adding
1-16     Sections 2306.026(c) and (d), Government Code, does not affect the
1-17     ability of a member of the board of the Texas Department of Housing
1-18     and Community Affairs who is serving on the effective date of this
1-19     Act to continue to serve the remainder of the term to which the
1-20     board member is appointed before that date.  As the terms of board
1-21     members expire or as vacancies are created on the board, the
1-22     governor shall appoint board members as necessary to comply with
1-23     Sections 2306.026(c) and (d), Government Code, as added by this
1-24     Act.
 2-1           SECTION 3.  This Act takes effect immediately if it receives
 2-2     a vote of two-thirds of all the members elected to each house, as
 2-3     provided by Section 39, Article III, Texas Constitution.  If this
 2-4     Act does not receive the vote necessary for immediate effect, this
 2-5     Act takes effect September 1, 2001.
