1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the authority of certain development corporations to
1-9 undertake water supply or conservation projects.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 4B(a)(2), Development Corporation Act of
1-12 1979 (Article 5190.6, Vernon's Texas Civil Statutes), is amended to
1-13 read as follows:
1-14 (2) "Project" means land, buildings, equipment,
1-15 facilities, and improvements included in the definition of that
1-16 term under Section 2 of this Act, and includes job training as
1-17 provided by Section 38 of this Act. For purposes of this section,
1-18 the term includes recycling facilities, and land, buildings,
1-19 equipment, facilities, and improvements found by the board of
1-20 directors to:
1-21 (A) be required or suitable for use for
1-22 professional and amateur (including children's) sports, athletic,
1-23 entertainment, tourist, convention, and public park purposes and
1-24 events, including stadiums, ball parks, auditoriums, amphitheaters,
1-25 concert halls, learning centers, parks and park facilities, open
1-26 space improvements, municipal buildings, museums, exhibition
1-27 facilities, and related store, restaurant, concession, and
1-28 automobile parking facilities, related area transportation
1-29 facilities, and related roads, streets, and water and sewer
1-30 facilities, and other related improvements that enhance any of
1-31 those items;
1-32 (B) promote or develop new or expanded business
1-33 enterprises, including a project to provide public safety
1-34 facilities, streets and roads, drainage and related improvements,
1-35 demolition of existing structures, general municipally owned
1-36 improvements, as well as any improvements or facilities that are
1-37 related to any of those projects and any other project that the
1-38 board in its discretion determines promotes or develops new or
1-39 expanded business enterprises; [or]
1-40 (C) be required or suitable for the promotion of
1-41 development and expansion of affordable housing, as defined by 42
1-42 U.S.C. Section 12745;
1-43 (D) be required or suitable for the development
1-44 or improvement of water supply facilities, including dams,
1-45 transmission lines, well field developments, and other water supply
1-46 alternatives; or
1-47 (E) be required or suitable for the development
1-48 and institution of water conservation programs, including
1-49 incentives to install water-saving plumbing fixtures, educational
1-50 programs, brush control programs, and programs to replace
1-51 malfunctioning or leaking water lines and other water facilities.
1-52 SECTION 2. This Act takes effect immediately if it receives
1-53 a vote of two-thirds of all the members elected to each house, as
1-54 provided by Section 39, Article III, Texas Constitution. If this
1-55 Act does not receive the vote necessary for immediate effect, this
1-56 Act takes effect September 1, 2001.
