A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to eligibility for retirement and benefits from the Texas
1-3 County and District Retirement System.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 844.102, Government Code, is amended to
1-6 read as follows:
1-7 Sec. 844.102. ELIGIBILITY FOR SERVICE RETIREMENT ANNUITY. A
1-8 member is eligible to apply for and receive a service retirement
1-9 annuity, if the member:
1-10 (1) is at least 60 years old and has at least 12 years
1-11 of credited service in the retirement system;
1-12 (2) has at least 30 years of credited service in the
1-13 retirement system; or
1-14 (3) has met the eligibility requirements for service
1-15 retirement under Section 844.207, 844.210, [or] 844.211, or
1-16 844.212.
1-17 SECTION 2. Subchapter C, Chapter 844, Government Code, is
1-18 amended by adding Section 844.212 to read as follows:
1-19 Sec. 844.212. OPTIONAL BENEFIT ELIGIBILITY PLAN THREE. (a)
1-20 In this section, "credited service" means credited service
1-21 performed for one or more participating subdivisions that have
1-22 adopted the plan provisions of this section.
1-23 (b) Subject to Subsection (d), the governing body of a
1-24 participating subdivision may adopt the plan provisions under
2-1 Subsection (c).
2-2 (c) A member is eligible to apply for and receive a service
2-3 retirement annuity if the member has at least 20 years of credited
2-4 service in the retirement system.
2-5 (d) The governing body of a subdivision may not adopt the
2-6 plan provisions of Subsection (c) except on the terms provided by
2-7 Subchapter H.
2-8 SECTION 3. Section 844.704(d), Government Code, is amended to
2-9 read as follows:
2-10 (d) The governing body of a subdivision that has adopted or
2-11 is adopting the plan provisions of this subchapter may adopt:
2-12 (1) the alternative optional increase in retirement
2-13 annuities under Section 844.209;
2-14 (2) the optional increase in retirement annuities
2-15 under Section 844.208;
2-16 (3) the optional authorization of the reestablishment
2-17 of credited service previously forfeited under Section 843.003;
2-18 (4) the optional authorization of the establishment of
2-19 credited service for military service under Section 843.601(c);
2-20 (5) the optional authorization of the establishment of
2-21 premembership credited service for overage employees under Section
2-22 843.204;
2-23 (6) the optional benefit eligibility plan described by
2-24 Section 844.210; [or]
2-25 (7) the optional benefit eligibility plan described by
2-26 Section 844.211; or
2-27 (8) the optional benefit eligibility plan described by
3-1 Section 844.212.
3-2 SECTION 4. This Act takes effect September 1, 2001.
