                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to reporting requirements regarding certain
 1-3     clothes-washing machines.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Chapter 372, Health and Safety Code, is amended by
 1-6     adding Section 372.004 to read as follows:
 1-7           Sec. 372.004.  REPORT TO LEGISLATURE. (a)  In this section,
 1-8     "water consumption factor" has the meaning assigned by 10 C.F.R.
 1-9     Part 430, Subpart B, Appendix J, as that appendix existed on
1-10     September 1, 2001.
1-11           (b)  This section does not apply to a clothes-washing machine
1-12     with a capacity of more than 3.5 cubic feet or less than 1.6 cubic
1-13     feet.
1-14           (c)  Beginning in February 2003, the commission shall report
1-15     to the legislature in January of each year on:
1-16                 (1)  the number of clothes-washing machines with a
1-17     water consumption factor of more than 11 that were imported into
1-18     this state during the preceding calendar year;
1-19                 (2)  the number of clothes-washing machines with a
1-20     water consumption factor of more than 9.5 but not more than 11 that
1-21     were imported into this state during the preceding calendar year;
1-22                 (3)  the number of clothes-washing machines with a
1-23     water consumption factor of 9.5 or less that were imported into
1-24     this state during the preceding calendar year; and
 2-1                 (4)  the average water consumption factor of all
 2-2     clothes-washing machines that were imported into this state during
 2-3     the preceding calendar year.
 2-4           (d)  The commission by rule shall require appropriate
 2-5     industry trade associations or other entities to provide the
 2-6     information described by Subsection (c)  to the commission by
 2-7     January 2003, and each January thereafter.
 2-8           SECTION 2. This Act takes effect September 1, 2001.
