No. 2403 as follows: 1-8 (1) In SECTION 1 of the bill, in added Section 372.004(c), 1-9 Health and Safety Code (House Engrossment page 1, lines 41 and 42), 1-10 strike "Beginning in February 2003, the commission shall report to 1-11 the legislature in January" and substitute "The commission shall 1-12 report to the legislature not later than February 28". 1-13 (2) In SECTION 1 of the bill, in added Section 372.004(d), 1-14 Health and Safety Code (House Engrossment page 1, lines 57 and 58), 1-15 strike "by January 2003, and each January thereafter" and 1-16 substitute "not later than January 31 of each year". 1-17 (3) Strike SECTION 2 of the bill and substitute the 1-18 following: 1-19 SECTION 2. (a) This Act takes effect September 1, 2001. 1-20 (b) The Texas Natural Resource Conservation Commission shall 1-21 submit to the legislature the initial report required by Section 1-22 372.004(c), Health and Safety Code, as added by this Act, in 1-23 February 2003. Appropriate trade associations or other entities 1-24 shall begin providing information to the commission as required by 1-25 Section 372.004(d), Health and Safety Code, as added by this Act, 1-26 in January 2003. 1-27 A BILL TO BE ENTITLED 1-28 AN ACT 1-29 relating to reporting requirements regarding certain 1-30 clothes-washing machines. 1-31 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-32 SECTION 1. Chapter 372, Health and Safety Code, is amended by 1-33 adding Section 372.004 to read as follows: 1-34 Sec. 372.004. REPORT TO LEGISLATURE. (a) In this section, 1-35 "water consumption factor" has the meaning assigned by 10 C.F.R. 1-36 Part 430, Subpart B, Appendix J, as that appendix existed on 1-37 September 1, 2001. 1-38 (b) This section does not apply to a clothes-washing machine 1-39 with a capacity of more than 3.5 cubic feet or less than 1.6 cubic 1-40 feet. 1-41 (c) Beginning in February 2003, the commission shall report 1-42 to the legislature in January of each year on: 1-43 (1) the number of clothes-washing machines with a 1-44 water consumption factor of more than 11 that were imported into 1-45 this state during the preceding calendar year; 1-46 (2) the number of clothes-washing machines with a 1-47 water consumption factor of more than 9.5 but not more than 11 that 1-48 were imported into this state during the preceding calendar year; 1-49 (3) the number of clothes-washing machines with a 1-50 water consumption factor of 9.5 or less that were imported into 1-51 this state during the preceding calendar year; and 1-52 (4) the average water consumption factor of all 1-53 clothes-washing machines that were imported into this state during 1-54 the preceding calendar year. 1-55 (d) The commission by rule shall require appropriate 1-56 industry trade associations or other entities to provide the 1-57 information described by Subsection (c) to the commission by 1-58 January 2003, and each January thereafter. 1-59 SECTION 2.
