                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the submetering of apartments, manufactured home rental
 1-3     communities, and other multiple use facilities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 13.502, Water Code, is amended to read as
 1-6     follows:
 1-7           Sec. 13.502.  SUBMETERING. (a)  The commission by rule shall
 1-8     require an [An apartment house] owner of an apartment house on
 1-9     which construction begins on or after January 1, 2003, a
1-10     manufactured home rental community owner, and a multiple use
1-11     facility owner to submeter [, or condominium manager may provide
1-12     for submetering of] each dwelling unit or rental unit for the
1-13     measurement of the quantity of water, if any, consumed by the
1-14     occupants of that unit.
1-15           (b)  An owner of an apartment house on which construction
1-16     began before January 1, 2003, and a condominium manager may provide
1-17     for submetering of each dwelling unit or rental unit for the
1-18     measurement of the quantity of water, if any, consumed by the
1-19     occupants of that unit.
1-20           SECTION 2. Subchapter M, Chapter 13, Water Code, is amended
1-21     by adding Section 13.506 to read as follows:
1-22           Sec. 13.506.  PLUMBING FIXTURES. (a)  In this section,
1-23     "plumbing fixture" has the meaning assigned by Section 372.001,
1-24     Health and Safety Code.
 2-1           (b)  The commission by rule  shall require an apartment house
 2-2     owner, manufactured home rental community owner, multiple use
 2-3     facility owner, or condominium manager to install plumbing fixtures
 2-4     that meet the standards of Section 372.002, Health and Safety Code,
 2-5     in the dwelling units and rental units that are not individually
 2-6     metered.
 2-7           SECTION 3. (a)  Section 1 of this Act takes effect September
 2-8     1, 2001.  Section 2 of this Act takes effect January 1, 2003.
 2-9           (b)  The Texas Natural Resource Conservation Commission shall
2-10     enact rules to implement Section 13.506, Water Code, as added by
2-11     this Act, and the changes in law to Section 13.502, Water Code, as
2-12     amended by this Act, not later than January 1, 2002.
