                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to public access to certain information and materials.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. The following provisions are repealed:
 1-5                 (1)  Sections 50.0225(h) and (i), Human Resources Code;
 1-6                 (2)  Sections 11B(h) and (i), Licensed Marriage and
 1-7     Family Therapist Act (Article 4512c-1, Vernon's Texas Civil
 1-8     Statutes);
 1-9                 (3)  Sections 5B(h) and (i), Chapter 498, Acts of the
1-10     62nd Legislature, Regular Session, 1971 (Article 4512d, Vernon's
1-11     Texas Civil Statutes);
1-12                 (4)  Sections 16D(h) and (i), Licensed Professional
1-13     Counselor Act (Article 4512g, Vernon's Texas Civil Statutes);
1-14                 (5)  Sections 16C(h) and (i), Licensed Dietitian Act
1-15     (Article 4512h, Vernon's Texas Civil Statutes);
1-16                 (6)  Sections 24A(h) and (i), Chapter 381, Acts of the
1-17     68th Legislature, Regular Session, 1983 (Article 4512j, Vernon's
1-18     Texas Civil Statutes);
1-19                 (7)  Sections 11B(h) and (i), Texas Medical Physics
1-20     Practice Act (Article 4512n, Vernon's Texas Civil Statutes);
1-21                 (8)  Sections 19A(h) and (i), Licensed Perfusionists
1-22     Act (Article 4529e, Revised Statutes);
1-23                 (9)  Sections 1.12C(h) and (i), Chapter 366, Acts of
1-24     the 61st Legislature, Regular Session, 1969 (Article 4566-1.12C,
 2-1     Vernon's Texas Civil Statutes); and
 2-2                 (10)  Sections 6A(h) and (i), Orthotics and Prosthetics
 2-3     Act (Article 8920, Revised Statutes).
 2-4           SECTION 2. The following sections of the Occupations Code, as
 2-5     added by the Act of the 77th Legislature, Regular Session, 2001,
 2-6     relating to nonsubstantive additions to and corrections in enacted
 2-7     codes, are repealed:
 2-8                 (1)  Sections 401.2535(h) and (i);
 2-9                 (2)  Sections 402.154(h) and (i);
2-10                 (3)  Sections 451.110(h) and (i);
2-11                 (4)  Sections 502.2045(h) and (i);
2-12                 (5)  Sections 503.2545(h) and (i);
2-13                 (6)  Sections 505.2545(h) and (i);
2-14                 (7)  Sections 602.1525(h) and (i);
2-15                 (8)  Sections 603.2041(h) and (i);
2-16                 (9)  Sections 605.2021(h) and (i); and
2-17                 (10)  Sections 701.2041(h) and (i).
2-18           SECTION 3. The following provisions are repealed:
2-19                 (1)  Sections 8C(h) and (i), Chapter 462, Acts of the
2-20     68th Legislature, Regular Session, 1983 (Article 4413(51), Vernon's
2-21     Texas Civil Statutes); and
2-22                 (2)  Sections 241.051(d) and (e) and 577.013(d) and
2-23     (e), Health and Safety Code.
2-24           SECTION 4.  Section 241.051, Health and Safety Code, is
2-25     amended by adding Subsection (f) to read as follows:
2-26           (f)  Information obtained or compiled by the department in
2-27     connection with a complaint or investigation that is confidential
 3-1     by law remains confidential and is not subject to disclosure under
 3-2     Chapter 552, Government Code.
 3-3           SECTION 5.  Section 577.013, Health and Safety Code, is
 3-4     amended by adding Subsection (f) to read as follows:
 3-5           (f)  Information obtained or compiled by the department in
 3-6     connection with a complaint or investigation that is confidential
 3-7     by law remains confidential and is not subject to disclosure under
 3-8     Chapter 552, Government Code.
 3-9           SECTION 6. (a)  Section 1 of this Act takes effect only if
3-10     the Act of the 77th Legislature, Regular Session, 2001, relating to
3-11     nonsubstantive additions to and corrections in enacted codes, does
3-12     not take effect.
3-13           (b)  Section 2 of this Act takes effect only if the Act of
3-14     the 77th Legislature, Regular Session, 2001, relating to
3-15     nonsubstantive additions to and corrections in enacted codes, takes
3-16     effect.
3-17           SECTION 7. This Act takes effect September 1, 2001.
