A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to continuing education requirements for code enforcement
1-3 officers.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 4(a), Chapter 796, Acts of the 72nd
1-6 Legislature, Regular Session, 1991 (Article 4447bb, Vernon's Texas
1-7 Civil Statutes), is amended to read as follows:
1-8 (a) The board by rule shall:
1-9 (1) adopt standards and education requirements
1-10 consistent with those established under Chapter 654, Government
1-11 Code [the Position Classification Act of 1961 (Article 6252-11,
1-12 Vernon's Texas Civil Statutes)], for the registration in this state
1-13 of code enforcement officers and code enforcement officers in
1-14 training; [and]
1-15 (2) prescribe application forms for original and
1-16 renewal certificates of registration; and
1-17 (3) prescribe annual continuing education requirements
1-18 for code enforcement officers and code enforcement officers in
1-19 training that:
1-20 (A) establish the number of hours of continuing
1-21 education required for renewal of a certificate of registration;
1-22 (B) establish an approved curriculum, which must
1-23 include material regarding changes in applicable law; and
1-24 (C) provide that the approved curriculum may be
2-1 taught by suitable public agencies and by private entities approved
2-2 by the department.
2-3 SECTION 2. Section 7(a), Chapter 796, Acts of the 72nd
2-4 Legislature, Regular Session, 1991 (Article 4447bb, Vernon's Texas
2-5 Civil Statutes), is amended to read as follows:
2-6 (a) A certificate of registration issued under this Act is
2-7 valid for one year and may be renewed annually on payment of the
2-8 required renewal fee and on completion of the annual continuing
2-9 education requirements prescribed by the board.
2-10 SECTION 3. The change in law made by this Act applies to the
2-11 renewal of a code enforcement officer certificate of registration
2-12 on or after September 1, 2002.
2-13 SECTION 4. This Act takes effect September 1, 2001.
