1-1                                   AN ACT
 1-2     relating to a referendum for a rail plan in certain metropolitan
 1-3     rapid transit authorities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 451.071(e), Transportation Code, is
 1-6     amended to read as follows:
 1-7           (e)  A subsequent referendum under Subsection (d):
 1-8                 (1)  may be held more than once;
 1-9                 (2)  is held in the same manner as the initial
1-10     referendum; and
1-11                 (3)  must be held at the general election in November
1-12     of an even-numbered year [may not be held before the first
1-13     anniversary of an election previously held under this section].
1-14           SECTION 2.  This Act takes effect immediately if it receives
1-15     a vote of two-thirds of all the members elected to each house, as
1-16     provided by Section 39, Article III, Texas Constitution.  If this
1-17     Act does not receive the vote necessary for immediate effect, this
1-18     Act takes effect September 1, 2001.
