                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the establishment of a medical board for University
 1-3     Interscholastic League athletic competitions and to parental
 1-4     involvement in decisions about student participation in the
 1-5     competitions.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1. Subchapter D, Chapter 33, Education Code, is
 1-8     amended by adding Section 33.0841 to read as follows:
 1-9           Sec. 33.0841.  UNIVERSITY INTERSCHOLASTIC LEAGUE MEDICAL
1-10     BOARD. (a)  The University Interscholastic League Medical Board is
1-11     composed of the following members appointed by the governor:
1-12                 (1)  one physician specializing in sports medicine;
1-13                 (2)  one physician specializing in general pediatric
1-14     medicine;
1-15                 (3)  one physician specializing in orthopedic medicine
1-16     and working with children or adolescents as an athletic team
1-17     physician;
1-18                 (4)  one pediatric neurologist or pediatric
1-19     neurosurgeon;
1-20                 (5)  one physician specializing in family medicine;
1-21                 (6)  one representative of the University
1-22     Interscholastic League;
1-23                 (7)  one athletic team coach working in a high school;
1-24                 (8)  one athletic trainer appropriately licensed and
 2-1     working in a high school; and
 2-2                 (9)  one chiropractor qualified as a certified
 2-3     chiropractic sports physician by the American Board of Chiropractic
 2-4     Sports Physicians.
 2-5           (b)  To be eligible to serve as a member of the medical
 2-6     board, a physician must be licensed and practicing medicine in the
 2-7     state and be of good standing in the medical profession.
 2-8           (c)  Members of the medical board serve staggered two-year
 2-9     terms, with the terms of the members described by Subsections
2-10     (a)(1)-(5) expiring on February 1 of each odd-numbered year and the
2-11     terms of the members described by Subsections (a)(6)-(9) expiring
2-12     on February 1 of each even-numbered year.  A member may serve more
2-13     than one term.
2-14           (d)  The governor shall select a chair from among the medical
2-15     board members.
2-16           (e)  A member of the medical board may not receive
2-17     compensation, but is entitled to reimbursement from the University
2-18     Interscholastic League for travel expenses incurred by the member
2-19     while conducting the business of the medical board.
2-20           (f)  The medical board shall by rule adopt a uniform medical
2-21     policy applicable to students, campuses, and school districts
2-22     participating in University Interscholastic League athletic
2-23     competitions.  The rules must include:
2-24                 (1)  minimum requirements for the content and
2-25     scheduling of any physical examinations and medical screenings
2-26     conducted to determine student eligibility for University
2-27     Interscholastic League athletic competitions;
 3-1                 (2)  criteria designed to ensure that any student who
 3-2     sustains a bodily injury is medically fit to resume training for or
 3-3     participating in a University Interscholastic League athletic
 3-4     competition; and
 3-5                 (3)  procedures designed to ensure that the parent or
 3-6     guardian of any student who sustains a bodily injury has all
 3-7     medical information necessary to be an informed participant in
 3-8     discussions regarding the student's resumption of training for or
 3-9     participation in a University Interscholastic League athletic
3-10     competition.
3-11           (g)  A rule adopted by the medical board under Subsection (f)
3-12     must be submitted to the commissioner and is not effective unless
3-13     the rule is approved by the commissioner.
3-14           (h)  If a school permits an ineligible student to participate
3-15     in a University Interscholastic League athletic competition in
3-16     violation of a rule adopted under Subsection (f), the State
3-17     Executive Committee of the University Interscholastic League shall
3-18     disqualify the team on which the student plays from further
3-19     competition.  The period of disqualification under this subsection
3-20     must be consistent with the period of disqualification for other
3-21     student ineligibility violations.
3-22           (i)  The commissioner may consult the medical board in
3-23     approving a University Interscholastic League rule under this
3-24     subchapter.
3-25           SECTION 2. (a)  As soon as possible after the effective date
3-26     of this Act, the governor shall appoint the initial members of the
3-27     University Interscholastic League Medical Board created under
 4-1     Section 33.0841, Education Code, as added by this Act.
 4-2           (b)  Not later than June 1, 2002, the University
 4-3     Interscholastic League Medical Board shall by rule adopt a uniform
 4-4     medical policy applicable to students, campuses, and school
 4-5     districts participating in University Interscholastic League
 4-6     athletic competitions and submit the rules to the commissioner of
 4-7     education for approval, as provided by Section 33.0841, Education
 4-8     Code, as added by this Act.
 4-9           SECTION 3. Except as otherwise provided by this Act, this Act
4-10     applies beginning with the 2002-2003 school year.
4-11           SECTION 4.  This Act takes effect immediately if it receives
4-12     a vote of two-thirds of all the members elected to each house, as
4-13     provided by Section 39, Article III, Texas Constitution.  If this
4-14     Act does not receive the vote necessary for immediate effect, this
4-15     Act takes effect September 1, 2001.
