No. 2452 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the establishment of a medical board for University 1-3 Interscholastic League athletic competitions and to parental 1-4 involvement in decisions about student participation in the 1-5 competitions. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. Subchapter D, Chapter 33, Education Code, is 1-8 amended by adding Section 33.0841 to read as follows: 1-9 Sec. 33.0841. UNIVERSITY INTERSCHOLASTIC LEAGUE MEDICAL 1-10 BOARD. (a) The University Interscholastic League Medical Board is 1-11 composed of the following members appointed by the governor: 1-12 (1) one physician specializing in sports medicine; 1-13 (2) one physician specializing in general pediatric 1-14 medicine; 1-15 (3) one physician specializing in orthopedic medicine 1-16 and working with children or adolescents as an athletic team 1-17 physician; 1-18 (4) one pediatric neurologist or pediatric 1-19 neurosurgeon; 1-20 (5) one physician specializing in family medicine; 1-21 (6) one representative of the University 1-22 Interscholastic League; 1-23 (7) one athletic team coach working in a high school; 1-24 and 2-1 (8) one athletic trainer appropriately licensed and 2-2 working in a high school. 2-3 (b) To be eligible to serve as a member of the medical 2-4 board, a physician must be licensed and practicing medicine in the 2-5 state and be of good standing in the medical profession. 2-6 (c) Members of the medical board serve staggered two-year 2-7 terms, with the terms of the members described by Subsections 2-8 (a)(1)-(4) expiring on February 1 of each odd-numbered year and the 2-9 terms of the members described by Subsections (a)(5)-(8) expiring 2-10 on February 1 of each even-numbered year. A member may serve more 2-11 than one term. 2-12 (d) The governor shall select a chair from among the medical 2-13 board members. 2-14 (e) A member of the medical board may not receive 2-15 compensation, but is entitled to reimbursement from the University 2-16 Interscholastic League for travel expenses incurred by the member 2-17 while conducting the business of the medical board. 2-18 (f) The medical board shall by rule adopt a uniform medical 2-19 policy applicable to students, campuses, and school districts 2-20 participating in University Interscholastic League athletic 2-21 competitions. The rules must include: 2-22 (1) minimum requirements for any physical examinations 2-23 and medical screenings conducted to determine student eligibility 2-24 for University Interscholastic League athletic competitions; 2-25 (2) criteria designed to ensure that any student who 2-26 sustains a bodily injury is medically fit to resume training for or 2-27 participating in a University Interscholastic League athletic 3-1 competition; and 3-2 (3) procedures designed to ensure that the parent or 3-3 guardian of any student who sustains a bodily injury has all 3-4 medical information necessary to make an informed decision 3-5 regarding the student's resumption of training for or participation 3-6 in a University Interscholastic League athletic competition. 3-7 (g) A rule adopted by the medical board under Subsection (f) 3-8 must be submitted to the commissioner and is not effective unless 3-9 the rule is approved by the commissioner. 3-10 (h) The State Executive Committee of the University 3-11 Interscholastic League shall disqualify a school from a University 3-12 Interscholastic League athletic competition if the school permits 3-13 an ineligible student to participate in the competition in 3-14 violation of a rule adopted under Subsection (f). The commissioner 3-15 shall determine the duration of the period of disqualification 3-16 under this subsection. 3-17 (i) The commissioner may consult the medical board in 3-18 approving a University Interscholastic League rule under this 3-19 subchapter. 3-20 SECTION 2. (a) As soon as possible after the effective date 3-21 of this Act, the governor shall appoint the initial members of the 3-22 University Interscholastic League Medical Board created under 3-23 Section 33.0841, Education Code, as added by this Act. 3-24 (b) Not later than June 1, 2002, the University 3-25 Interscholastic League Medical Board shall by rule adopt a uniform 3-26 medical policy applicable to students, campuses, and school 3-27 districts participating in University Interscholastic League 4-1 athletic competitions and submit the rules to the commissioner of 4-2 education for approval, as provided by Section 33.0841, Education 4-3 Code, as added by this Act. 4-4 SECTION 3. Except as otherwise provided by this Act, this Act 4-5 applies beginning with the 2002-2003 school year. 4-6 SECTION 4. This Act takes effect immediately if it receives 4-7 a vote of two-thirds of all the members elected to each house, as 4-8 provided by Section 39, Article III, Texas Constitution. If this 4-9 Act does not receive the vote necessary for immediate effect, this 4-10 Act takes effect September 1, 2001.
