1-1 AN ACT
1-2 relating to the composition of the governing board of certain
1-3 community college districts.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 130.040, Education Code, is amended to
1-6 read as follows:
1-7 Sec. 130.040. BOARD OF TRUSTEES: UNION, COUNTY, OR
1-8 JOINT-COUNTY JUNIOR COLLEGE. A union junior college, a county
1-9 junior college, or a joint-county junior college shall be governed,
1-10 administered, and controlled by and under the direction of a board
1-11 of trustees of seven members unless the number of members is
1-12 increased as authorized by Section 130.082(d).
1-13 SECTION 2. Sections 130.0821(b), (c), and (e), Education
1-14 Code, are amended to read as follows:
1-15 (b) The board of trustees shall divide the district into the
1-16 appropriate number of [seven] compact trustee districts which
1-17 contain as nearly as practicable an equal number of inhabitants
1-18 according to the last preceding federal census. Residents of each
1-19 trustee district shall be entitled to elect one member of the
1-20 board, and each candidate seeking to represent a trustee district
1-21 must reside in the trustee district he seeks to represent.
1-22 Trustees shall, during their term of office, reside within the
1-23 trustee district from which they were elected.
1-24 (c) Members of the board of trustees of the district shall
2-1 serve for staggered terms of six years with the terms of one-third
2-2 of the [two or three] members, as nearly as may be, expiring in
2-3 each even-numbered year [years].
2-4 (e) Within 90 days following the publication of census tract
2-5 data compiled during each subsequent decennial federal census, the
2-6 board of trustees shall redivide the district into the appropriate
2-7 number of [seven] trustee districts if such census data indicates
2-8 that the population of the most populous trustee district exceeds
2-9 the population of the least populous district by more than 10
2-10 percent. Within 90 days following the effective date of an order
2-11 or resolution of the board of trustees to increase the number of
2-12 board members, the board of trustees shall redivide the district
2-13 into the appropriate number of trustee districts as increased. At
2-14 the next district election following the redivision of the district
2-15 under this subsection, each trustee district shall elect a member
2-16 of the board, and the members elected shall draw lots for the
2-17 appropriate number of [two] two-year [terms], [two] four-year
2-18 [terms], and [three] six-year terms as needed to establish
2-19 staggered terms as required by Subsection (c).
2-20 SECTION 3. This Act takes effect immediately if it receives
2-21 a vote of two-thirds of all the members elected to each house, as
2-22 provided by Section 39, Article III, Texas Constitution. If this
2-23 Act does not receive the vote necessary for immediate effect, this
2-24 Act takes effect September 1, 2001.
