 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the composition of the governing board of certain
 1-9     community college districts.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 130.040, Education Code, is amended to
1-12     read as follows:
1-13           Sec. 130.040.  BOARD OF TRUSTEES:  UNION, COUNTY, OR
1-14     JOINT-COUNTY JUNIOR COLLEGE. A union junior college, a county
1-15     junior college, or a joint-county junior college shall be governed,
1-16     administered, and controlled by and under the direction of a board
1-17     of trustees of seven members unless the number of members is
1-18     increased as authorized by Section 130.082(d).
1-19           SECTION 2. Sections 130.0821(b), (c), and (e), Education
1-20     Code, are amended to read as follows:
1-21           (b)  The board of trustees shall divide the district into the
1-22     appropriate number of [seven] compact trustee districts which
1-23     contain as nearly as practicable an equal number of inhabitants
1-24     according to the last preceding federal census.  Residents of each
1-25     trustee district shall be entitled to elect one member of the
1-26     board, and each candidate seeking to represent a trustee district
1-27     must reside in the trustee district he seeks to represent.
1-28     Trustees shall, during their term of office, reside within the
1-29     trustee district from which they were elected.
1-30           (c)  Members of the board of trustees of the district shall
1-31     serve for staggered terms of six years with the terms of one-third
1-32     of the [two or three] members, as nearly as may be, expiring in
1-33     each even-numbered year [years].
1-34           (e)  Within 90 days following the publication of census tract
1-35     data compiled during each subsequent decennial federal census, the
1-36     board of trustees shall redivide the district into the appropriate
1-37     number of [seven] trustee districts if such census data indicates
1-38     that the population of the most populous trustee district exceeds
1-39     the population of the least populous district by more than 10
1-40     percent.  Within 90 days following the effective date of an order
1-41     or resolution of the board of trustees to increase the number of
1-42     board members, the board of trustees shall redivide the district
1-43     into the appropriate number of trustee districts as increased.  At
1-44     the next district election following the redivision of the district
1-45     under this subsection, each trustee district shall elect a member
1-46     of the board, and the members elected shall draw lots for the
1-47     appropriate number of [two] two-year [terms], [two] four-year
1-48     [terms], and [three] six-year terms as needed to establish
1-49     staggered terms as required by Subsection (c).
1-50           SECTION 3.  This Act takes effect immediately if it receives
1-51     a vote of two-thirds of all the members elected to each house, as
1-52     provided by Section 39, Article III, Texas Constitution.  If this
1-53     Act does not receive the vote necessary for immediate effect, this
1-54     Act takes effect September 1, 2001.
