                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation of a judicial district composed of Fannin
 1-3     County and the composition of the 6th and 336th judicial districts.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. The heading to Section 24.106, Government Code, is
 1-6     amended to read as follows:
 1-7           Sec. 24.106.  6TH JUDICIAL DISTRICT ([FANNIN,] LAMAR[,] AND
 1-8     RED  RIVER COUNTIES).
 1-9           SECTION 2. Section 24.106(a), Government Code, is amended to
1-10     read as follows:
1-11           (a)  The 6th Judicial District is composed of [Fannin,]
1-12     Lamar[,] and Red River counties.
1-13           SECTION 3. The heading to Section 24.482, Government Code, is
1-14     amended to read as follows:
1-15           Sec. 24.482.  336TH JUDICIAL DISTRICT ([FANNIN AND] GRAYSON
1-16     COUNTY [COUNTIES]).
1-17           SECTION 4. Section 24.482(a), Government Code, is amended to
1-18     read as follows:
1-19           (a)  The 336th Judicial District is composed of [Fannin and]
1-20     Grayson County [counties].
1-21           SECTION 5. Subchapter C, Chapter 24, Government Code, is
1-22     amended by adding Section 24.560 to read as follows:
1-23           Sec. 24.560.  416TH JUDICIAL DISTRICT (FANNIN COUNTY). The
1-24     416th Judicial District is composed of Fannin County.
 2-1           SECTION 6. (a)  The 416th Judicial District is created and
 2-2     this Act takes effect September 1, 2001.
 2-3           (b)  The local administrative district judge shall transfer
 2-4     all cases from Fannin County that are pending in the 6th District
 2-5     Court or the 336th District Court on the effective date of this Act
 2-6     to the 416th District Court.
 2-7           (c)  When a case is transferred from one court to another as
 2-8     provided by Subsection (b) of this section, all processes, writs,
 2-9     bonds, recognizances, or other obligations issued from the
2-10     transferring court are returnable to the court to which the case is
2-11     transferred, as if originally issued by that court.  The obligees
2-12     in all bonds and recognizances taken in and for a court from which
2-13     a case is transferred, and all witnesses summoned to appear in a
2-14     court from which a case is transferred, are required to appear
2-15     before the court to which a case is transferred as if originally
2-16     required to appear before the court to which the transfer is made.
