                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the expiration of alcoholic beverage permits and
 1-3     licenses.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 11.09, Alcoholic Beverage Code, is amended
 1-6     by adding Subsection (d) to read as follows:
 1-7           (d)  The commission may adopt rules that allow a person who
 1-8     applies for or renews a type of permit designated by the commission
 1-9     to choose an expiration date for the permit that falls on an
1-10     anniversary of the date the permit would otherwise expire under
1-11     this code if the fee for the permit is increased proportionately.
1-12           SECTION 2. Section 61.03, Alcoholic Beverage Code, is amended
1-13     by amending Subsection (a) and adding Subsection (d) to read as
1-14     follows:
1-15           (a)  Except as provided by Subsection (b) or (d), a license
1-16     may not be issued for a term longer than one year.  Any license
1-17     except a branch, importer's, importer's carrier's, or temporary
1-18     license expires one year after the date on which it is issued.
1-19           (d)  The commission may adopt rules that allow a person who
1-20     applies for or renews a type of license designated by the
1-21     commission to choose an expiration date for the license that falls
1-22     on an anniversary of the date the license would otherwise expire
1-23     under this code if the fee for the license is increased
1-24     proportionately.
 2-1           SECTION 3. This Act takes effect September 1, 2001.
