1-1                                   AN ACT
 1-2     relating to the validation of certain actions and of the legal
 1-3     description of Harris County Water Control and Improvement District
 1-4     No. 84.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  DEFINITION. In this Act, "district" means Harris
 1-7     County Water Control and Improvement District No. 84.
 1-8           SECTION 2.  VALIDATION. Except as provided by Section 6 of
 1-9     this Act, all resolutions, orders, and other acts or attempted acts
1-10     of the board of directors of the district relating to annexations
1-11     by the district and all annexations by the district since its
1-12     creation are validated, ratified, and approved in all respects and
1-13     have affected the boundaries of the district as described by
1-14     Section 3 of this Act.  All the resolutions, orders, and other acts
1-15     or attempted acts of the board of directors of the district and all
1-16     annexations of the district are valid as though they had originally
1-17     been legally authorized or accomplished.
1-18           SECTION 3.  LEGAL DESCRIPTION. The following metes and bounds
1-19     description is validated as the accurate legal description of the
1-20     boundaries of the district:
1-21     BEING 765.7019 acres of land, more or less, more particularly
1-22     described by metes and bounds as follows:
1-23     TRACT #1
1-24     A tract of land situated in the County of Harris, State of Texas,
 2-1     being a part of the Peter J. Duncan Survey, A-232, a part of the
 2-2     B.N. Sessums Survey, A-733, and a part of the Solomon Jacobs
 2-3     Survey, A-487, and being more particularly described as follows:
 2-4     BEGINNING at a stone monument marking the southwest corner of the
 2-5     Solomon Jacobs Survey, A-487, and the southeast corner of the S.
 2-6     Singleton Survey, A-704;

 26-5          SECTION 4.  FINDINGS RELATIVE TO BOUNDARIES. The legislature
 26-6    finds that the boundaries and field notes of the district  form a
 26-7    closure.  A mistake in the field notes or in copying the field
 26-8    notes in the legislative process does not affect the organization,
 26-9    existence, or validity of the district, the right of the district
26-10    to levy and collect taxes, or the legality or operation of the
26-11    district or its governing body.
26-12          SECTION 5.  EFFECT ON LITIGATION. This Act does not apply to
26-13    any matter that on the effective date of this Act:
26-14                (1)  is involved in litigation if the litigation
26-15    ultimately results in the matter being held invalid by a final
26-16    judgment of a court of competent jurisdiction; or
26-17                (2)  has been held invalid by a final judgment of a
26-18    court of competent jurisdiction.
26-19          SECTION 6.  PENDING ANNEXATIONS. This Act does not apply to
26-20    or affect annexation orders of the district adopted on or after
26-21    January 1, 2001.  If the district adopts any annexation orders on
26-22    or after January 1, 2001, and before the effective date of this
26-23    Act, the boundaries of the district are the boundaries described by
26-24    Section 3 of this Act as modified to include the land added by
26-25    those orders.
26-26          SECTION 7.  REPEALER. Section 3, Chapter 878, Acts of the
26-27    72nd Legislature, Regular Session, 1991, is repealed.
 27-1          SECTION 8.  EFFECTIVE DATE. This Act takes effect immediately
 27-2    if it receives a vote of two-thirds of all the members elected to
 27-3    each house, as provided by Section 39, Article III, Texas
 27-4    Constitution.  If this Act does not receive the vote necessary for
 27-5    immediate effect, this Act takes effect September 1, 2001.
