 1-7                                   AN ACT
 1-8     relating to the validation of certain actions and of the legal
 1-9     description of Harris County Water Control and Improvement District
1-10     No. 84.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  DEFINITION. In this Act, "district" means Harris
1-13     County Water Control and Improvement District No. 84.
1-14           SECTION 2.  VALIDATION. Except as provided by Section 6 of
1-15     this Act, all resolutions, orders, and other acts or attempted acts
1-16     of the board of directors of the district relating to annexations
1-17     by the district and all annexations by the district since its
1-18     creation are validated, ratified, and approved in all respects and
1-19     have affected the boundaries of the district as described by
1-20     Section 3 of this Act.  All the resolutions, orders, and other acts
1-21     or attempted acts of the board of directors of the district and all
1-22     annexations of the district are valid as though they had originally
1-23     been legally authorized or accomplished.
1-24           SECTION 3.  LEGAL DESCRIPTION. The following metes and bounds
1-25     description is validated as the accurate legal description of the
1-26     boundaries of the district:
1-27     BEING 765.7019 acres of land, more or less, more particularly
1-28     described by metes and bounds as follows:
1-29     TRACT #1
1-30     A tract of land situated in the County of Harris, State of Texas,
1-31     being a part of the Peter J. Duncan Survey, A-232, a part of the
1-32     B.N. Sessums Survey, A-733, and a part of the Solomon Jacobs
1-33     Survey, A-487, and being more particularly described as follows:
1-34     BEGINNING at a stone monument marking the southwest corner of the

10-67          SECTION 4.  FINDINGS RELATIVE TO BOUNDARIES. The legislature
10-68    finds that the boundaries and field notes of the district  form a
10-69    closure.  A mistake in the field notes or in copying the field
 11-1    notes in the legislative process does not affect the organization,
 11-2    existence, or validity of the district, the right of the district
 11-3    to levy and collect taxes, or the legality or operation of the
 11-4    district or its governing body.
 11-5          SECTION 5.  EFFECT ON LITIGATION. This Act does not apply to
 11-6    any matter that on the effective date of this Act:
 11-7                (1)  is involved in litigation if the litigation
 11-8    ultimately results in the matter being held invalid by a final
 11-9    judgment of a court of competent jurisdiction; or
11-10                (2)  has been held invalid by a final judgment of a
11-11    court of competent jurisdiction.
11-12          SECTION 6.  PENDING ANNEXATIONS. This Act does not apply to
11-13    or affect annexation orders of the district adopted on or after
11-14    January 1, 2001.  If the district adopts any annexation orders on
11-15    or after January 1, 2001, and before the effective date of this
11-16    Act, the boundaries of the district are the boundaries described by
11-17    Section 3 of this Act as modified to include the land added by
11-18    those orders.
11-19          SECTION 7.  REPEALER. Section 3, Chapter 878, Acts of the
11-20    72nd Legislature, Regular Session, 1991, is repealed.
11-21          SECTION 8.  EFFECTIVE DATE. This Act takes effect immediately
11-22    if it receives a vote of two-thirds of all the members elected to
11-23    each house, as provided by Section 39, Article III, Texas
11-24    Constitution.  If this Act does not receive the vote necessary for
11-25    immediate effect, this Act takes effect September 1, 2001.
