                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the application of the child support guidelines to
 1-3     certain children receiving social security old age benefits.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter C, Chapter 154, Family Code, is amended
 1-6     by adding Section 154.133 to read as follows:
 1-7           Sec. 154.133.  APPLICATION OF GUIDELINES TO CHILDREN OF
 1-8     OBLIGORS RECEIVING SOCIAL SECURITY.  In applying the child support
 1-9     guidelines for an obligor who is receiving social security old age
1-10     benefits and who is required to pay support for a child who
1-11     receives benefits as a result of the obligor's receipt of social
1-12     security old age benefits, the court shall apply the guidelines by
1-13     determining the amount of child support that would be ordered under
1-14     the child support guidelines and subtracting from that total the
1-15     amount of benefits or the value of the benefits paid to or for the
1-16     child as a result of the obligor's receipt of social security old
1-17     age benefits.
1-18           SECTION 2. (a)  This Act takes effect September 1, 2001, and
1-19     applies only to an order for child support issued on or after that
1-20     date.  An order for child support issued before the effective date
1-21     of this Act is governed by the law in effect when the order was
1-22     issued, and the former law is continued in effect for that purpose.
1-23           (b)  The change in law made by this Act does not by itself
1-24     constitute a material and substantial change of circumstances under
 2-1     Section 156.401, Family Code, sufficient in and of itself to
 2-2     warrant modification of a court order or a portion of a decree that
 2-3     provides for the support of a child rendered before the effective
 2-4     date of this Act.
