 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the application of the child support guidelines to
 1-9     certain children receiving social security old age benefits.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Subchapter C, Chapter 154, Family Code, is amended
1-12     by adding Section 154.133 to read as follows:
1-13           Sec. 154.133.  APPLICATION OF GUIDELINES TO CHILDREN OF
1-14     OBLIGORS RECEIVING SOCIAL SECURITY.  In applying the child support
1-15     guidelines for an obligor who is receiving social security old age
1-16     benefits and who is required to pay support for a child who
1-17     receives benefits as a result of the obligor's receipt of social
1-18     security old age benefits, the court shall apply the guidelines by
1-19     determining the amount of child support that would be ordered under
1-20     the child support guidelines and subtracting from that total the
1-21     amount of benefits or the value of the benefits paid to or for the
1-22     child as a result of the obligor's receipt of social security old
1-23     age benefits.
1-24           SECTION 2. This Act takes effect September 1, 2001, and
1-25     applies to a child support order entered before, on, or after that
1-26     date.
