1-1 AN ACT
1-2 relating to the jurisdiction of a municipal court.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 29.003(b), Government Code, is amended to
1-5 read as follows:
1-6 (b) The municipal court has concurrent jurisdiction with the
1-7 justice court of a precinct in which the municipality is located in
1-8 all criminal cases arising under state law that[:]
1-9 [(1)] arise within the municipality's territorial
1-10 limits or property owned by the municipality located in the
1-11 municipality's extraterritorial jurisdiction and that:
1-12 (1) are punishable only by a fine, as defined in
1-13 Subsection (c); or
1-14 (2) arise under Chapter 106, Alcoholic Beverage Code,
1-15 and do not include confinement as an authorized sanction.
1-16 SECTION 2. The change in law made by this Act to Section
1-17 29.003(b), Government Code, applies only to the jurisdiction of a
1-18 municipal court in a criminal case for which the trial begins on or
1-19 after September 1, 2001. The jurisdiction of a municipal court in
1-20 a criminal case for which the trial begins before September 1,
1-21 2001, is governed by the law in effect when the trial begins, and
1-22 the former law is continued in effect for that purpose.
1-23 SECTION 3. This Act takes effect September 1, 2001.
