1-7 AN ACT
1-8 relating to motorcycle operator and passenger safety.
1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10 SECTION 1. Section 661.004, Transportation Code, is amended
1-11 to read as follows:
1-12 Sec. 661.004. AUTHORITY OF PEACE OFFICER TO STOP AND DETAIN
1-13 CERTAIN MOTORCYCLE OPERATORS AND PASSENGERS [INSPECT PROTECTIVE
1-14 HEADGEAR]. If a peace officer reasonably believes a motorcycle
1-15 operator or passenger is under the age of 21 and not wearing a
1-16 helmet, the [Any peace] officer may stop and detain the [a] person
1-17 [who is a motorcycle operator or passenger] to determine whether
1-18 the person is in violation of Section 661.003 [inspect the person's
1-19 protective headgear for compliance with the safety standards
1-20 prescribed by the department].
1-21 SECTION 2. Section 662.011, Transportation Code, is amended
1-22 by adding Subsection (c) to read as follows:
1-23 (c) The comptroller shall report to the governor and
1-24 legislature not later than the first Monday in November of each
1-25 even-numbered year on the condition of the account. The report
1-26 must contain:
1-27 (1) a statement of the amount of money deposited to
1-28 the credit of the account for the year;
1-29 (2) a statement of the amount of money disbursed by
1-30 the comptroller from the account for the year;
1-31 (3) a statement of the balance of money in the
1-32 account;
1-33 (4) a list of persons and entities that have received
1-34 money from the account, including information for each person or
1-35 entity that shows the amount of money received; and
1-36 (5) a statement of any significant problems
1-37 encountered in administering the account, with recommendations for
1-38 their solution.
1-39 SECTION 3. Chapter 662, Transportation Code, is amended by
1-40 adding Section 662.012 to read as follows:
1-41 Sec. 662.012. REPORTS. (a) The designated state agency
1-42 shall require each provider of a motorcycle operator training and
1-43 safety program to compile and forward to the agency each month a
1-44 report on the provider's programs. The report must include:
1-45 (1) the number and types of courses provided in the
1-46 reporting period;
1-47 (2) the number of persons who took each course in the
1-48 reporting period;
1-49 (3) the number of instructors available to provide
1-50 training under the provider's program in the reporting period;
1-51 (4) information collected by surveying persons taking
1-52 each course as to the length of any waiting period the person
1-53 experienced before being able to enroll in the course;
1-54 (5) the number of persons on a waiting list for a
1-55 course at the end of the reporting period; and
1-56 (6) any other information the agency reasonably
1-57 requires.
1-58 (b) The designated state agency shall maintain a compilation
1-59 of the reports submitted under Subsection (a) on a by-site basis.
1-60 The agency shall update the compilation as soon as practicable
1-61 after the beginning of each month.
1-62 (c) The designated state agency shall provide without charge
1-63 a copy of the most recent compilation under Subsection (b) to any
1-64 member of the legislature on request.
2-1 SECTION 4. Section 1701.253, Occupations Code, is amended by
2-2 adding Subsection (e) to read as follows:
2-3 (e) As part of the minimum curriculum requirements relating
2-4 to the vehicle and traffic laws of this state, the commission shall
2-5 require an education and training program on laws relating to the
2-6 operation of motorcycles and to the wearing of protective headgear
2-7 by motorcycle operators and passengers. In addition, the
2-8 commission shall require education and training on motorcycle
2-9 operator profiling awareness and sensitivity training.
2-10 SECTION 5. This Act takes effect September 1, 2001.
