                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the requirement that a parent provide certain
 1-3     information to the other parent of the child;  providing a penalty.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 153.076, Family Code, is amended by
 1-6     amending Subsection (d) and adding Subsections (e) and (f) to read
 1-7     as follows:
 1-8           (d)  A parent who provides notice of a change in residence
 1-9     and address information under Section 105.006(b) to the other
1-10     parent shall maintain a record of the notice provided to the other
1-11     parent and of the manner in which the notice was provided.
1-12           (e)  A person commits an offense if the person fails to
1-13     provide:
1-14                 (1)  the notice required by Subsection (b) in the
1-15     manner required by Subsection [Subsections (b) and] (c); or
1-16                 (2)  the notice of residence and address information
1-17     required by Section 105.006(a)(2) in the manner required by Section
1-18     105.006(b) to the other parent of the person's child.
1-19           (f)  An offense under this section [subsection] is a Class B
1-20     [C] misdemeanor.
1-21           SECTION 2. This Act takes effect September 1, 2001.
1-22           SECTION 3. (a)  The change in law made by this Act to Section
1-23     153.076, Family Code, applies only to an offense committed on or
1-24     after the effective date of this Act.  For purposes of this
 2-1     section, an offense is committed before the effective date of this
 2-2     Act if any element of the offense occurs before that date.
 2-3           (b)  An offense committed before the effective date of this
 2-4     Act is covered by the law in effect when the offense was committed,
 2-5     and the former law is continued in effect for that purpose.
