By Chavez H.B. No. 2596 77R2881 JMG-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the use of development corporations to improve local 1-3 telecommunications infrastructure. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 2(11)(A), Development Corporation Act of 1-6 1979 (Article 5190.6, Vernon's Texas Civil Statutes), is amended to 1-7 read as follows: 1-8 (A) "Project" shall mean the land, buildings, 1-9 equipment, facilities, targeted infrastructure, and improvements 1-10 (one or more) to promote new and expanded business development or 1-11 found by the board of directors to be required or suitable for the 1-12 promotion of development and expansion of manufacturing and 1-13 industrial facilities, job creation and retention, job training, 1-14 educational facilities, telecommunications infrastructure, 1-15 transportation facilities (including but not limited to airports, 1-16 ports, mass commuting facilities, and parking facilities), sewage 1-17 or solid waste disposal facilities, recycling facilities, air or 1-18 water pollution control facilities, facilities for the furnishing 1-19 of water to the general public, distribution centers, small 1-20 warehouse facilities capable of serving as decentralized storage 1-21 and distribution centers, and facilities for use by institutions of 1-22 higher education, and for the promotion of development or 1-23 redevelopment and expansion, including costs of administration and 1-24 operation, of a military base closed or realigned pursuant to 2-1 recommendation of the Defense Closure and Realignment Commission 2-2 pursuant to the Defense Base Closure and Realignment Act of 1990 2-3 (10 U.S.C. Section 2687 note) as amended, and of facilities which 2-4 are related to any of the foregoing, and in furtherance of the 2-5 public purposes of this Act, all as defined in the rules of the 2-6 department, irrespective of whether in existence or required to be 2-7 identified, acquired, or constructed thereafter. 2-8 "Project" also includes job training required or suitable for 2-9 the promotion of development and expansion of business enterprises 2-10 and other enterprises described by this Act, as provided by Section 2-11 38 of this Act. 2-12 SECTION 2. This Act takes effect immediately if it receives 2-13 a vote of two-thirds of all the members elected to each house, as 2-14 provided by Section 39, Article III, Texas Constitution. If this 2-15 Act does not receive the vote necessary for immediate effect, this 2-16 Act takes effect September 1, 2001.
