A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the tuition to be charged to certain foreign students.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 54.060(b), Education code, is amended to
1-5 read as follows:
1-6 (b) The foreign student tuition fee prescribed in this
1-7 chapter does not apply to a foreign student who is a resident of a
1-8 nation situated adjacent to Texas, who demonstrates financial need
1-9 as provided by this subsection, and who registers in:
1-10 (1) any general academic teaching institution, as
1-11 defined in Section 61.003(3) of this code;[, or]
1-12 (2) a component of the Texas State Technical College
1-13 System located in a county immediately adjacent to the nation in
1-14 which the foreign student resides;
1-15 (3) [or who registers for] lower division courses at a
1-16 community or junior college having a partnership agreement pursuant
1-17 to Subchapter N, Chapter 51, of this code, with an upper-level
1-18 university and both institutions are located in the county
1-19 immediately adjacent to the nation in which the foreign student
1-20 resides;[,]
1-21 (4) [or who registers in] Texas A&M
1-22 University--Kingsville or Texas A&M University--Corpus Christi; or
2-1 (5) courses that are part of a graduate program in
2-2 public health that are offered in a county immediately adjacent to
2-3 the nation in which the foreign student resides [and, except as
2-4 provided by this subsection, who demonstrates a financial need
2-5 after the financial resources of the foreign student and the
2-6 student's family are considered]. The foreign student described in
2-7 this subsection shall pay tuition equal to that charged Texas
2-8 residents under Sections 54.051 and 54.0512 of this code. The
2-9 coordinating board shall adopt rules governing the determination of
2-10 financial need of students under this subsection and rules
2-11 governing a pilot project to be established at general academic
2-12 teaching institutions and at components of the Texas State
2-13 Technical College System in counties that are not immediately
2-14 adjacent to the nation in which the foreign student resides.
2-15 SECTION 2. This Act takes effect immediately if it receives a
2-16 vote of two-thirds of all the members elected to each house, as
2-17 provided by Section 39, Article III, Texas Constitution. If this
2-18 Act does not receive the vote necessary for immediate effect, this
2-19 Act takes effect September 1, 2001.
