A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the application of the professional prosecutors law to
1-3 and the compensation of the county attorney of Rains County.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 45.290, Government Code, is amended to
1-6 read as follows:
1-7 Sec. 45.290. Rains County. (a) In Rains County, the county
1-8 attorney of Rains County shall perform the duties imposed on and
1-9 have the powers conferred on district attorneys by general law.
1-10 (b) The county attorney of Rains County is entitled to be
1-11 compensated by [receive an amount from] the state in the manner and
1-12 amount fixed by general law relating to [equal to 30 percent of]
1-13 the salary paid to [a] district attorneys [attorney] by the state
1-14 [for the purpose of supplementing the salary of the county
1-15 attorney]. Rains County is also entitled to receive from the state
1-16 an amount equal to the amount provided in the General
1-17 Appropriations Act to district attorneys for the payment of staff
1-18 salaries and expenses of the office.
1-19 [(c) The commissioners court of Rains County shall continue
1-20 to provide funds for the office of the county attorney in an amount
1-21 that is equal to or greater than the amount of funds provided for
1-22 the office by the county on the effective date of this Act.]
1-23 SECTION 2. Section 46.002, Government Code, is amended to
1-24 read as follows:
2-1 Sec. 46.002. Prosecutors Subject to Chapter. This chapter
2-2 applies to all county prosecutors and to the following state
2-3 prosecutors:
2-4 (1) the district attorneys for the 1st, 2nd, 8th, 9th,
2-5 12th, 18th, 21st, 23rd, 26th, 27th, 29th, 32nd, 33rd, 34th, 35th,
2-6 36th, 38th, 43rd, 47th, 49th, 50th, 51st, 52nd, 53rd, 63rd, 64th,
2-7 66th, 69th, 70th, 76th, 81st, 84th, 85th, 88th, 90th, 97th, 100th,
2-8 105th, 106th, 110th, 118th, 119th, 123rd, 142nd, 145th, 156th,
2-9 159th, 173rd, 196th, 198th, 216th, 220th, 229th, 235th, 253rd,
2-10 259th, 266th, 268th, 271st, 278th, 286th, 329th, 349th, and 355th
2-11 judicial districts;
2-12 (2) the criminal district attorneys for the counties
2-13 of Anderson, Austin, Bastrop, Bexar, Bowie, Brazoria, Caldwell,
2-14 Calhoun, Cass, Collin, Comal, Dallas, Deaf Smith, Denton, Eastland,
2-15 Galveston, Gregg, Harrison, Hays, Hidalgo, Jasper, Jefferson,
2-16 Kaufman, Lubbock, McLennan, Madison, Navarro, Newton, Panola, Polk,
2-17 Randall, Rockwall, San Jacinto, Smith, Tarrant, Taylor, Tyler,
2-18 Upshur, Van Zandt, Victoria, Walker, Waller, Wichita, Wood, and
2-19 Yoakum; and
2-20 (3) the county attorneys performing the duties of
2-21 district attorneys in the counties of Andrews, Callahan, Cameron,
2-22 Castro, Colorado, Crosby, Ellis, Falls, Fannin, Freestone, Grayson,
2-23 Lamar, Lamb, Lampasas, Lee, Limestone, Marion, Milam, Morris,
2-24 Ochiltree, Orange, Rains, Red River, Robertson, Rusk, Terry, Webb,
2-25 and Willacy.
2-26 SECTION 3. This Act takes effect September 1, 2001.
